SENATE BILL NO. 863

A bill to amend 1982 PA 302, entitled
"An act to create the Michigan justice training commission and
the Michigan justice training fund; to provide the powers and
duties of certain state agencies; to provide for the distribution
and expenditure of funds; and to provide for the promulgation of
rules,"
by amending section 2 (MCL 18.422), as amended by 1989 PA 158.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2. (1) The Michigan justice training commission is
2 created within the department of management and budget. The com-
3 mission shall consist of the following members:
4 (a) The director of the department of state police or his or
5 her representative.
6 (b) The president of the prosecuting attorneys' association
7 of Michigan or his or her representative.
8 (c) The president of the Michigan sheriffs'
association or
9 his or her representative. TWO SHERIFFS, OR THEIR

1 REPRESENTATIVES, APPOINTED BY THE PRESIDENT OF THE MICHIGAN
2 SHERIFFS' ASSOCIATION AS FOLLOWS:
3 (i) ONE FROM A COUNTY WITH A POPULATION UNDER 100,000.
4 (ii) ONE FROM A COUNTY WITH A POPULATION OF 100,000 OR
MORE.
5 (D) THE PRESIDENT OF THE DEPUTY SHERIFF ASSOCIATION OF
6 MICHIGAN OR HIS OR HER REPRESENTATIVE.
7 (E) (d) The president of the Michigan
association of
8 chiefs of police or his or her representative.
9 (F) (e) One person appointed by the governor
who is
10 employed by a police agency employing at least 20% of the police
11 officers in this state.
12 (G) (f) The president of the Michigan state
police troop-
13 ers association or his or her representative.
14 (H) (g) One person appointed by the governor
who has been
15 elected by police officers other than police officers in adminis-
16 trative or managerial positions, representing the interests of
17 police officers other than police officers in administrative or
18 managerial positions.
19 (I) (h) The president of the criminal
defense attorneys of
20 Michigan or his or her representative.
21 (2) The commission shall elect a chairperson annually from
22 among the members of the commission. A person shall not serve
23 more than 2 consecutive years as chairperson.
24 (3) The members of the commission shall be reimbursed for
25 actual expenses, including travel expenses, from the fund.
26 Members of the commission shall not be reimbursed for
27 expenditures for alcoholic liquor, or for meal expenditures in

1 excess of the per diem meal expenditures authorized for members
2 of the state civil service.
3 (4) The business which OF the commission
may perform
4 shall be conducted at a public meeting of the commission held in
5 compliance with the open meetings act, Act No. 267 of the
Public
6 Acts of 1976, as amended, being sections 15.261 to 15.275 of
the
7 Michigan Compiled Laws 1976 PA 267, MCL 15.261 TO
15.274.
8 Public notice of the time, date, and place of the meeting shall
9 be given in the manner required by Act No. 267 of the
Public
10 Acts of 1976, as amended COMPLIANCE WITH THE OPEN
MEETINGS ACT,
11 1976 PA 267, MCL 15.261 TO 15.275.
12 (5) The commission shall not perform any function authorized
13 under section 3 without the affirmative votes of 5
NOT LESS
14 THAN 6 members of the commission.
