SENATE BILL NO. 1099 May 5, 1998, Introduced by Senator CISKY and referred to the Committee on Judiciary. A bill to amend 1966 PA 331, entitled "Community college act of 1966," by amending sections 128, 129, and 131 (MCL 389.128, 389.129, and 389.131), as added by 1998 PA 51. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 128. (1) Subject to subsections (2) and (3), the board 2 of trustees of a community college created under this act may 3 grant to the public safety officers or police officers of that 4 community college the powers and authority of a peace or law 5 enforcement officer. Public safety officers or police officers 6 granted the powers and authority under this act shall have the 7 same powers and authority of a peace officer under the code of 8 criminal procedure, 1927 PA 175, MCL 760.1 to 776.22, and as 9 provided under the Michigan vehicle code, 1949 PA 300, MCL 257.1 10 to 257.923. 06345'98 JJG 2 1 (2) Before granting the powers and authority provided under 2 subsection (1), a board of trustees of a community college shall 3 conduct not less than 2 public hearings. 4 (3) The board of trustees of a community college shall not 5 grant the powers and authority described in subsection (1) unless 6 that board of trustees creates a public safetyoversight7 ADVISORY committee. The public safetyoversightADVISORY com- 8 mittee shall be comprised of 2 members of the faculty and 2 mem- 9 bers of the staff of the community college. The public safety 10oversightADVISORY committee shall receive and address griev- 11 ances by persons against the public safety officers or police 12 officers or against the public safety department or police 13 department of that community college. The committee may recom- 14 mend to the board of trustees or the administration of that com- 15 munity college that disciplinary measures be taken against a 16 public safety officer or police officer who is found responsible 17 for misconduct in office. 18 Sec. 129. (1) The jurisdiction of public safety officers or 19 police officers granted powers and authority of peace or law 20 enforcement officers under section 128 shall include all property 21 owned or leased by the community college in this state and 22 extends to the public right-of-way traversing or contiguous to 23 that property. 24 (2) The jurisdiction of public safety officers or police 25 officers under subsection (1) is limited to the protection of 26 persons and property on the property of that community college 27 unlessan emergencyA response is made off campus at the 06345'98 3 1 specific request of another law enforcement agency OR UNDER A 2 MUTUAL AID AGREEMENT WITH ANOTHER LAW ENFORCEMENT AGENCY. 3 Sec. 131. The public safety department or police department 4 of each community college shall submit monthly uniform crime 5 reports pertaining to crimes within the department's jurisdiction 6 to the department of state police IN THE SAME MANNER as pre- 7 scribed in section 1 of 1968 PA 319, MCL 28.251. 06345'98 Final page.
