SENATE BILL NO. 1143

A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 35105 (MCL 324.35105), as amended by 1996 PA 290. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 35105. (1) The following are prohibited on state land 2 in a wilderness area, wild area, or natural area, or on state 3 land proposed by the department for dedication in 1 of these cat- 4 egories during the 90 days a dedication is pending pursuant to 5 section 35103: 6 (a) Removing EXCEPT AS PROVIDED IN SUBSECTION (3), 7 REMOVING, cutting, picking, or otherwise altering vegetation, 8 except as necessary for appropriate public access, the 9 preservation or restoration of a plant or wildlife species, or 05535'98 JCB 2 1 the documentation of scientific values and with written consent 2 of the department. 3 (b) Except as provided in subsection (2), granting an ease- 4 ment for any purpose. 5 (c) Exploration for or extraction of minerals. 6 (d) A commercial enterprise, utility or permanent road. 7 (e) A temporary road, landing of aircraft, use of motor 8 vehicles, motorboats, or other form of mechanical transport, or 9 any structure or installation, except as necessary to meet mini- 10 mum emergency requirements for administration as a wilderness 11 area, wild area, or natural area by the department. 12 (f) Motorized equipment, except if the department approves 13 its use for management purposes or conservation practices. 14 (2) If a right-of-way or an easement for ingress and egress 15 was granted on land prior to the land's designation as a wilder- 16 ness area, wild area, or natural area, upon request, the depart- 17 ment may grant an easement along the route of the existing 18 right-of-way or easement for the installation and maintenance of 19 utilities for gas, electric, telephone, and cable services. In 20 granting an easement under this section, the department shall 21 require conditions necessary to protect the wilderness area, wild 22 area, or natural area. 23 (3) A PERSON MAY PICK WILD MUSHROOMS ON STATE LAND IN A WIL- 24 DERNESS AREA, WILD AREA, OR NATURAL AREA OR ON STATE LAND PRO- 25 POSED BY THE DEPARTMENT FOR DEDICATION IN 1 OF THE CATEGORIES 26 LISTED IN SUBSECTION (1). 05535'98 Final page.
