SENATE BILL NO. 1172 June 2, 1998, Introduced by Senator KOIVISTO and referred to the Committee on Natural Resources and Environmental Affairs. A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 11505 (MCL 324.11505). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 11505. (1) "Recyclable materials" means source sepa- 2 rated materials, site separated materials, high grade paper, 3 glass, metal, plastic, aluminum, newspaper, corrugated paper, 4 yard clippings, and other materials that may be recycled or 5 composted. 6 (2) "Regional solid waste management planning agency" means 7 the regional solid waste planning agency designated by the gover- 8 nor pursuant to section 4006 of subtitle D of the solid waste 9 disposal act, title II of Public Law 89-272, 42 U.S.C. 6946. 10 (3) "Resource recovery facility" means machinery, equipment, 11 structures, or any parts or accessories of machinery, equipment, 06371'98 JCB 2 1 or structures, installed or acquired for the primary purpose of 2 recovering materials or energy from the waste stream. 3 (4) "Response activity" means an activity that is necessary 4 to protect the public health, safety, welfare, or the environ- 5 ment, and includes, but is not limited to, evaluation, cleanup, 6 removal, containment, isolation, treatment, monitoring, mainte- 7 nance, replacement of water supplies, and temporary relocation of 8 people. 9 (5) "Rubbish" means nonputrescible solid waste, excluding 10 ashes, consisting of both combustible and noncombustible waste, 11 including paper, cardboard, metal containers, yard clippings, 12 wood, glass, bedding, crockery, demolished building materials, or 13 litter of any kind that may be a detriment to the public health 14 and safety. 15 (6) "Salvaging" means the lawful and controlled removal of 16 reusable materials from solid waste. 17 (7) "Site separated material" means glass, metal, wood, 18 paper products, plastics, rubber, textiles, garbage, yard clip- 19 pings, or any other material approved by the department that is 20 separated from solid waste for the purpose of conversion into raw 21 materials or new products. Site separated material does not 22 include the residue remaining after glass, metal, wood, paper 23 products, plastics, rubber, textiles, or any other material 24 approved by the department is separated from solid waste. 25 (8) "Slag" means the nonmetallic product resulting from 26 melting or smelting operations for iron,orsteel, OR COPPER. 06371'98 Final page.
