SENATE BILL NO. 1179


   June 3, 1998, Introduced by Senator STILLE and referred to the
        Committee on Natural Resources and Environmental Affairs.



        A bill to amend 1994 PA 451, entitled

   "Natural resources and environmental protection act,"

   by amending section 11715 (MCL 324.11715).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 11715.  (1) If a governmental unit requires that all

 2    septage waste collected in that governmental unit be disposed of

 3    in a septage waste treatment facility or prohibits, or effec-

 4    tively prohibits, the application of septage waste to land within

 5    that governmental unit, the governmental unit shall make avail-

 6    able a public septage waste treatment facility that can lawfully

 7    accept all septage waste generated within that governmental unit

 8    that is not lawfully applied to land.

 9         (2) The owner or operator of a public septage waste

10    treatment facility  shall not  MAY require the
             posting of a

11    surety, including cash in an escrow account or a performance

 1    bond, to dispose of septage waste in the public septage waste
