SENATE BILL NO. 1295 September 16, 1998, Introduced by Senators SHUGARS, YOUNG and STILLE and referred to the Committee on Finance. A bill to establish the organ donor education fund in the department of community health; to provide for the distribution of money from the fund; to prescribe the duties and powers of certain agencies and officials; and to provide for appropriations. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. This act shall be known and may be cited as the 2 "organ donor education fund act". 3 Sec. 2. As used in this act: 4 (a) "Department" means the department of community health. 5 (b) "Fund" means the organ donor education fund created in 6 section 3. 7 Sec. 3. (1) The organ donor education fund is created in 8 the department to provide funds to promote community education in 9 this state relating to organ donation. 05206'97 RJA 2 1 (2) The state treasurer shall direct the investment of the 2 fund. 3 (3) Money in the fund at the close of the year shall remain 4 in the fund and shall not lapse to the general fund. 5 (4) The fund shall consist of all money credited to the fund 6 pursuant to section 438 of the income tax act of 1967, 1967 PA 7 281, MCL 206.438, any interest and earnings accruing from the 8 saving and investment of that money, grants, and other appropria- 9 tions, money, or things of value. 10 Sec. 4. The principal, interest, and earnings of the fund 11 shall be expended solely for the purposes described in this act. 12 Sec. 5. Until the assets in the fund exceed $5,000,000.00, 13 not more than 50% of the money deposited into the fund each year, 14 plus the earnings credited to the fund during the immediately 15 preceding fiscal year, are available for distribution under this 16 act. For each tax year after the tax year in which the state 17 treasurer certifies that the assets in the fund exceed 18 $5,000,000.00, only the earnings credited to the fund are avail- 19 able for distribution under this act. 20 Sec. 6. Money granted or received as a gift or donation to 21 the fund is available for distribution upon appropriation. Money 22 authorized for expenditure is not an asset for purposes of sec- 23 tion 5. 24 Sec. 7. With the money from the fund, the department shall 25 provide statewide educational information that develops public 26 awareness concerning organ donation programs in this state and 27 makes information about organ donation programs available to the 05206'97 3 1 public and to organizations and agencies that can encourage organ 2 donations through the following means: 3 (a) Public service announcements and programs and other edu- 4 cational materials disseminated by the department and the secre- 5 tary of state. 6 (b) Grants provided to federally recognized organ procure- 7 ment centers in this state to provide education to increase 8 awareness of the need for organ donors with a goal of increasing 9 organ donations. 10 Sec. 8. The department shall solicit and approve proposals 11 for grants for funding under this act. 12 Sec. 9. The money in the fund that is available for distri- 13 bution shall be appropriated each year. 14 Enacting section 1. This act does not take effect unless 15 Senate Bill No. 1296 16 of the 89th Legislature is enacted into law. 05206'97 Final page. RJA
