SENATE BILL NO. 1310 September 17, 1998, Introduced by Senator JAYE and referred to the Committee on Hunting, Fishing and Forestry. A bill to amend 1927 PA 372, entitled "An act to regulate and license the selling, purchasing, possess- ing, and carrying of certain firearms and gas ejecting devices; to prohibit the buying, selling, or carrying of certain firearms and gas ejecting devices without a license; to provide for the forfeiture of firearms possessed in violation of this act; to provide immunity from civil liability under certain circum- stances; to prescribe the powers and duties of certain state and local agencies; and to repeal all acts and parts of acts incon- sistent with the provisions of this act," by amending section 1 (MCL 28.421), as amended by 1992 PA 219. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. As used in this act: 2 (A) "ANTIQUE FIREARM" MEANS EITHER OF THE FOLLOWING: 3 (i) A FIREARM THAT WAS NOT DESIGNED OR REDESIGNED FOR USING 4 RIMFIRE OR CONVENTIONAL CENTER FIRE IGNITION WITH FIXED AMMUNI- 5 TION AND THAT WAS MANUFACTURED IN 1898 OR EARLIER, INCLUDING A 6 MATCHLOCK, FLINTLOCK, PERCUSSION CAP, OR SIMILAR TYPE OF IGNITION 7 SYSTEM OR A REPLICA OF THAT TYPE OF FIREARM, REGARDLESS OF THE 06101'98 TVD 2 1 TYPE OF IGNITION SYSTEM, WHETHER ACTUALLY MANUFACTURED IN 1898 OR 2 EARLIER. 3 (ii) A FIREARM USING FIXED AMMUNITION MANUFACTURED IN 1898 4 OR EARLIER, FOR WHICH AMMUNITION IS NO LONGER MANUFACTURED IN THE 5 UNITED STATES AND IS NOT READILY AVAILABLE IN THE ORDINARY CHAN- 6 NELS OF COMMERCIAL TRADE. 7 (B)(a)"Firearm" means a weapon from which a dangerous 8 projectile may be propelled by an explosive, or by gas or air. 9 Firearm does not includea smooth boreAN ANTIQUE FIREARM OR A 10 rifle or handgun designed and manufactured exclusively for pro- 11 pelling by a spring, or by gas or air,BB'sBBS OR PELLETS not 12 exceeding.177.22 caliber. 13 (C)(b)"Pistol" means a loaded or unloaded firearm that 14 is 30 inches or less in length, or a loaded or unloaded firearm 15 that by its construction and appearance conceals it as a 16 firearm. 17 (D)(c)"Purchaser" means a person who receives a pistol 18 from another person by purchase, gift, or loan. 19 (E)(d)"Seller" means a person who sells, furnishes, 20 loans, or gives a pistol to another person. 06101'98 Final page.
