The Speaker, on behalf of the entire membership of the House of Representatives, offered the following resolution:
House Resolution No. 392.
A resolution offered as a memorial for Gilbert E. Bursley, former member of the House and the Senate.
Whereas, It is with deep appreciation for his contributions to Michigan as a lawmaker and educator and his devotion to our country in the military and service overseas that we honor the memory of Gilbert E. Bursley. Over the course of his remarkable life, he displayed patriotism and commitment that will long endure as a rich legacy; and
Whereas, The son of a University of Michigan professor, Gil Bursley was born in Ann Arbor and earned degrees at Michigan and Harvard. Like so many of his generation, war changed his life forever. He distinguished himself in World War II and Korea, rising to the rank of Lieutenant Colonel with the Army and serving as a military attache in Turkey and as a senior advisor in the Middle East. He later provided leadership with the United States Information Agency in Africa. His international exploits gave him invaluable perspectives on life; and
Whereas, Upon his return to Michigan, Gil Bursley channeled his talents through the University of Michigan Development Council and became active in civic affairs. In 1960, he was elected to the first of two terms in the House of Representatives and a span of service as a Michigan legislator that extended until his retirement from the Senate in 1978. As a lawmaker, Gil Bursley was a champion of education who left his imprint on policies that continue to reap rewards for our state; and
Whereas, Even after leaving the State Capitol, Mr. Bursley authored new chapters in service, in addition to writing a book about his foreign service. He also served as the president of Cleary College and spearheaded the school's outreach programs. Indeed, Gil Bursley, through his adventures and sacrifices, lived a full and enriching life for the great benefit of the people of Michigan and our entire country; now, therefore, be it
Resolved by the House of Representatives, That we offer this expression of our highest tribute to honor the memory of Gilbert E. Bursley, former member of the House and the Michigan Senate; and be it further
Resolved, That copies of this resolution be transmitted to the Bursley family as evidence of our sincere condolences.

"An act to provide for the licensing and regulation of adult foster care facilities; to provide for the establishment of standards of care for adult foster care facilities; to prescribe powers and duties of the department of social services and other departments; to prescribe certain fees; to prescribe penalties; and to repeal certain acts and parts of acts,".

House Bill No. 6006, entitled
A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending sections 11503 and 11506 (MCL 324.11503 and 324.11506), section 11503 as amended by 1996 PA 359 and section 11506 as amended by 1996 PA 392.

The question being on the passage of the bill,
Rep. Birkholz moved to amend the bill as follows:
1. Amend page 8, following line 16, by inserting:
"Sec. 11547. (1) In order for a county to effectively implement the planning responsibilities designated under this part, a grant program is established to provide financial assistance to county or regional solid waste management planning agencies. Municipalities joined together with interlocal agreements relating to solid waste management plans, within a county having a city of a population of more than 1 million 750,000, are eligible for a separate planning grant in addition to those granted to counties. This separate grant allocation provision does not alter the planning and approval process requirements for county plans as specified in this part. Eighty percent of the money for the program not provided for by federal funds shall be appropriated annually by the legislature from the general fund of the state and 20% shall be appropriated by the applicant. Grant funds appropriated for local planning may be used by the department if the department finds it necessary to invoke the department's authority to develop a local plan under section 11533(6). The department shall promulgate rules for the distribution of the appropriated funds.
(2) In order for a certified health department to effectively implement the responsibilities designated under this part, an annual grant shall be appropriated by the legislature from the general fund of the state to provide financial assistance to a certified health department. A certified health department is eligible to receive 100% of reasonable personnel costs as determined by the department based on criteria established by rule. The department shall promulgate rules for the distribution of the appropriated funds.".

THE PUBLIC MEETING SHALL BE CONDUCTED TO ALERT MEMBERS OF THE PUBLIC THAT 1 OR MORE PRESCRIBED BURNS MAY OCCUR AND WHAT THE PURPOSE AND ANTICIPATED CONSEQUENCES OF THE PRESCRIBED BURN WILL BE. IN ADDITION, MEMBERS OF THE PUBLIC SHALL HAVE AN OPPORTUNITY AT THE PUBLIC MEETING TO EXPRESS THEIR CONCERNS AND OPINIONS REGARDING A PRESCRIBED BURN.
(2) FOR A PRESCRIBED BURN OF MORE THAN 40 ACRES, IN ADDITION TO THE REQUIREMENT FOR A PUBLIC MEETING UNDER SUBSECTION (1), THE DEPARTMENT SHALL NOTIFY EACH LOCAL FIRE DEPARTMENT WITH JURISDICTION OVER THE PROJECTED BURN AREA AND SHALL PUBLISH A PUBLIC NOTICE IN A NEWSPAPER WITH A GENERAL CIRCULATION COVERING THE PROJECTED BURN AREA THAT A PRESCRIBED BURN IS SCHEDULED TO OCCUR WITHIN A DESIGNATED 60-DAY PERIOD. THE NOTIFICATION AND PUBLICATION SHALL TAKE PLACE NOT LESS THAN 2 WEEKS BEFORE THE FIRST DAY OF THE 60-DAY PERIOD. THE NOTICE PUBLISHED UNDER THIS SUBSECTION SHALL BE DRAFTED IN THE MANNER THAT THE DEPARTMENT DETERMINES IS BEST SUITED TO PROVIDE NOTICE TO RESIDENTS IN OR NEAR THE PROJECTED BURN AREA.".

(A) A PRESCRIBED BURN ON ALL OR A PORTION OF HIS OR HER PROPERTY.
(B) A WAIVER OR SPECIFIED REDUCTION OF THE 100-FOOT BUFFER ZONE.
(4) THE DEPARTMENT SHALL NOT INTENTIONALLY CONDUCT A PRESCRIBED BURN WITHIN A BUFFER ZONE ESTABLISHED UNDER THIS SECTION.".

A resolution of tribute for the Honorable Curtis Hertel, Speaker of the House of Representatives.
Whereas, As the Eighty-ninth Michigan Legislature draws to a close, it is most fitting to salute Speaker Curtis Hertel in recognition of his outstanding service to this institution and the people of our state. His exemplary leadership in an era of landmark changes will long be remembered. As he completes his responsibilities, we are proud to offer our sincerest thanks; and
Whereas, A lifelong Detroiter, Curtis Hertel has advanced a remarkable family tradition of public service in elective office to the people of Michigan. With his achievements in leadership with the House of Representatives, the Speaker has strengthened the place of the Hertel name in Michigan political history; and
Whereas, A graduate of Wayne State University, Speaker Hertel was first elected to the House in 1980. With his energy, quick grasp of issues, and sense of commitment, he earned the trust of his colleagues while serving his district with great effectiveness. This trust extended far beyond his own caucus, as in 1993, he helped craft the historic shared power agreement that guided the Eighty-seventh Legislature. Along with his counterpart, Paul Hillegonds, Curtis Hertel worked to make the two-year session a very productive period, instead of the disruptive time many feared. This success, which garnered national acclaim, was the direct result of the personal civility, integrity, and mutual trust between Co-Speaker Hertel and Co-Speaker Hillegonds; and
Whereas, A host of key policy changes have taken place due to the leadership of Speaker Hertel. Michigan's advances in education and economic vitality and efforts to address the needs of working people and families all reflect his personal concern for our state and its future; now, therefore, be it

His wide-ranging experiences and his leadership in civic groups have strengthened our state in many key issue areas; and
Whereas, Representative Murphy has compiled an impressive record through his involvement in community organizations. His professional background with the courts has blended with his work as a delegate to the convention that shaped our state's constitution in 1961-62 to give him invaluable insights into how the legislative process touches the lives of our citizens and how we live and work. Since 1982, when he was first elected to the Michigan House of Representatives, he has put these insights to work on behalf of his Detroit district and our entire state; and
Whereas, Over the course of his eight terms as a lawmaker, Raymond Murphy has taken on many leadership posts in the House. He has chaired the Labor and Occupational Safety Committee and served as the Assistant Democratic Floor Leader and as Speaker Pro Tempore. To each of these responsibilities, he has brought an abundant understanding of the process and the institution of government, which has provided an invaluable example for others to follow. Ray Murphy has also distinguished himself through his efforts on a variety of special projects, including the work to study and promote high-speed rail transportation. She has directed her talents and knowledge to a host of key community, education, and health organizations and institutions over the years, both before and during her tenure as a lawmaker. For twelve years, she distinguished herself as a member of the Ottawa County Board of Commissioners, which included serving as the first woman chair in history. Her grasp of local issues and her understanding of the impact of state actions on local government have brought an important perspective to the Capitol; and

Whereas, John Llewellyn, a graduate of Alma College, compiled an impressive record in public service and agriculture prior to embarking upon service in the Michigan Legislature following his 1992 election to the House. As an orchard owner, he has vital experience in one of Michigan's key agricultural areas. In addition to this demanding work, he has fashioned a second career in community service. His involvements include efforts as a Newaygo County Commissioner, member of his township zoning appeals and health boards, service to the county zoning and planning board and public works board, and efforts with agricultural organizations. This background prepared him well for the issues and negotiations of state government; and
Whereas, Representative Llewellyn's record in the House is marked by accomplishments in several areas, especially in addressing insurance concerns. For the Eighty-eighth Legislature, he chaired the Insurance Committee. His other committee responsibilities have included his most recent assignments with the Constitutional and Civil Rights, Health Policy, and Labor and Occupational Safety Committees, in addition to being the minority vice chair of Insurance. Whereas, A native of Oakland County, Tom Middleton distinguished himself in agriculture long before directing his considerable talents and energies to public service. In addition to his experience owning and operating a farm, he also exercised leadership with a host of farm organizations. Since his 1990 election to the Michigan House of Representatives, Representative Middleton has brought his communications and problem-solving skills to the challenge of developing state-wide public policy; and
Whereas, Representative Middleton has channeled his abilities and energies through his work on several committees, in addition to his direct efforts with his constituents. He has displayed understanding of issues throughout his duties with the House Education, Forestry and Mineral Rights, Tax Policy, and Transportation Committees most recently, and in his leadership with the Eighty-eighth Legislature as the chair of the Agriculture Committee. Whereas, Michael Nye, a veteran of military service with the Army, came to Lansing and the State Capitol following his election in 1982. Over the years, this talented gentleman has earned great respect through his ability, understanding of issues, and willingness to resolve difficult problems. A graduate of Purdue University who earned his juris doctorate at the University of Detroit, Representative Nye has brought to his legislative duties the unique perspective of being an attorney and a farmer. His affiliations have included both legal groups and local agricultural organizations; and
Whereas, Representative Nye has been a key figure in several areas of public policy. He has contributed his expertise to the development of legislation on Michigan's justice system and major changes in property taxes and school financing. Highlights of his wide-ranging committee work include his accomplishments on agriculture and corrections issues and his achievements as the former chair of the House Judiciary Committee. Whereas, A native of Detroit who earned his bachelor's degree in communications from Michigan State University, Dennis Olshove won the first of his four consecutive terms representing the people of his Warren and Sterling Heights district in 1990. Representative Olshove has devoted himself to the difficult task of matching limited resources with the needs of our state. In addressing this challenge, he has relied upon his experiences, including his involvement in several community groups and his prior responsibilities as a legislative staff member; and
Whereas, Among Representative Olshove's most important contributions have been his efforts in committee work. Most recently, he has directed his energies to the committees on commerce, marine affairs, regulatory affairs, and transportation. His example of commitment has earned him the respect of his fellow lawmakers and staff; and
Whereas, A decorated veteran of service to our country with the Marine Corps in Vietnam, Lynn Owen has exhibited a strong sense of personal duty in various elements of public service. Prior to his 1984 election to the House, he was active in local government as a township supervisor and assessor. He has also been a leader in public safety organizations, including fire departments and ambulance service operations. These responsibilities, coupled with his involvement in civic groups, including several veterans organizations, have given him insights that have been helpful in his work as a legislator; and
Whereas, Representative Owen, in addition to his diligence in responding to the needs and concerns of his community, has rendered important service as a member of the House Appropriations Committee. He is a graduate of Manchester College who earned his master's degree at Western Michigan University and taught mathematics and computer science for many years in the Sturgis Public Schools. In addition to his work in public education, Representative Oxender has also garnered experience as a farmer, as a leader in his church, and as a community activist; and
Whereas, Representative Oxender has been especially active through his legislative career in the realm of education. Whereas, A graduate of Taylor University who earned his master's degree at Wheaton College, Tim Walberg was first elected to the Michigan House of Representatives in 1982. He brought with him considerable experience in the ministry, where he worked with individuals and families. He has also been active with various service groups, providing counsel and helping solve problems. This work has certainly blended well with his responsibilities as a lawmaker; and
Whereas, Representative Walberg has been diligent in his committee duties, articulating the needs and rights of our state's citizens. Whereas, A proud son of a farming family, Howard Wetters earned his bachelor's degree at Michigan State University and operated Wetters Farms in Bay County for several years before turning his talents and energies to public service. His background includes work as an extension agent, aide to the House Agriculture Committee, and advisor to the governor on agriculture and natural resources issues. The experiences gained in these posts have been most useful since he came to Lansing as a legislator following the 1992 election; and
Whereas, Representative Wetters has distinguished himself in committee work. A member of the Conservation, Environment and Recreation, Public Utilities, Tax Policy, and Tourism Committees, he has provided notable leadership as the chair of the Agriculture Committee as it has addressed such complex issues as land use and revisions to the Drain Code. His understanding of the legislative process and the problems facing our state has been very helpful to members and staff on both sides of the political aisle. Whereas, A graduate of Eastern Michigan University, Karen Willard earned her law degree at the University of Detroit. Prior to her 1992 election to the House of Representatives, she distinguished herself in the legal profession. Her experiences teaching legal writing at the University of Detroit Law School and her activism with various committees of the State Bar of Michigan have proven invaluable during her work as a lawmaker. She has been especially effective in promoting understandable language in the law and other public documents; and
Whereas, Representative Willard has directed her energies and talents to many issue areas during her three terms as a legislator. Whereas, It is with a strong sense of admiration for his tireless efforts on behalf of the people of Upper Peninsula that we salute Ellwood Mattson as he is recognized for a lifetime of achievement. His service and philanthropy as advocate for numerous causes, marks over a half-century of effective and efficient public service. We salute this remarkable man for his leadership, dedication and commitment, confident that Upper Peninsula will long benefit from his efforts; and
Whereas, At the inception of his over fifty-years of service with MFC First National Bank of Marquette, Michigan, Ellwood Mattson recognized the important role that banking plays in contributing to both the economic well-being of the community and the lives of its citizenry. At a time in our history in which local officials face many challenges and changes, Ellwood Mattson took the initiative and responded with energy and a heartfelt concern for the citizens, businesses, and institutions of Michigan's Northern Peninsula. Ellwood has received numerous awards for his extensive philanthropy, leadership, and citizenship, and in 1989, Marquette County felt it fitting to dedicate the Ellwood A. Mattson Lower Harbor Park in his honor; and
Whereas, A native of Iron Mountain, Michigan, graduating from Iron Mountain High School in 1936, Ellwood went on to attend Northern Michigan University where he earned a Bachelor of Science degree in Business Administration. Finding he had an interest in finance, Ellwood enrolled in the University of Wisconsin School of Banking and in 1947, began his career at MFC First National Bank of Marquette. Serving as Assistant to the President, he climbed his way up the corporate ladder to Chairman of the Board and President for both MFC and the Michigan Financial Corporation. Ellwood also served as past State Treasurer of the Michigan Banker's Association and helped to start the Northern Michigan School of Banking. He was appointed by Governor James Blanchard to serve as a member of the State Natural Resources Commission, and most recently, by Governor John Engler to serve on the Northern Michigan University Board of Control; and
Whereas, President Harry S. Truman once said, "Progress occurs when courageous, skillful leaders seize the opportunity to change things for the better." Throughout his career, Ellwood Mattson has long been recognized as a leader, not only in the banking and business circles, but also through his extensive involvement in the community. Through his work as President of the Marquette Area Chamber of Commerce, his involvement with area school districts and universities, area hospitals, Veteran's organizations, the K.I. Sawyer Air Force Base Redevelopment Board, downtown development committees, and various other economic associations, he has truly made the Upper Peninsula a better place to live and work; now, therefore, be it
Resolved by the House of Representatives, That it is with great esteem that we applaud Ellwood A. Mattson on this well-deserved honor as he is recognized for a lifetime of achievement. Whereas, A specialty license plate program can serve several worthwhile purposes. Plates promoting one of our fine universities, for example, can help raise funds for that university. A family with a strong history of enjoying our state parks could show this support not only with a license plate depicting the parks, but also with the money spent to buy them. Specialty plates could also help raise support for worthwhile activities; and
Whereas, Efforts to publicize Michigan's riches can only help the promotion of tourism and advance the overall image of our state as a wonderful place to live, work, or do business. Civic pride can also have a strong positive impact on our own citizens; and
Whereas, In recent years, Michigan vehicle owners have demonstrated considerable interest in more attractive license plates. With the added benefit of directing increased support to valued resources, there is significant potential for this concept; now, therefore, be it

Whereas, Four tribes have negotiated compacts with the Governor to provide for tribal gaming operations through the framework established by federal law; and

"Sec. 5i. (1) Whether or not authorized by its charter, a city with a population of more than 1,000,000 750,000 may provide by ordinance a procedure to finance by special assessments the provision by private contractors of snow removal from streets, mosquito abatement, and security services. The ordinance shall authorize the use of petitions to initiate the establishment of a special assessment district. The record owners of not less than 51% of the land comprising the actual special assessment district must have signed the petitions.
(2) A service instituted under this section may be discontinued upon petition by the record owners of 51% of the land comprising the special assessment district.
Sec. 35a. Any municipality now or hereafter having a population of one million 750,000 or more may issue general obligation bonds and other evidences of debt for all lawful purposes in accordance with the provisions of state law, but subject to the overall debt limitations provided by state law or charter of any such city. No charter shall allocate the debt limitation or any part thereof to specific purposes.".
