A SUMMARY OF HOUSE BILL 4009 AS INTRODUCED 1-13-99


House Bill 4009 would amend the Michigan Penal Code to make the acquisition or attempted acquisition of another person's "personal identity information" to use in the commission of a crime a felony. A conviction would be punishable by imprisonment for not more than four years, a fine of not more than $2,000, or both. Additionally, the bill would not prohibit the individual's conviction or sentencing for any other crimes that he or she had committed by using the information obtained in violation of the bill's provisions.


"Personal identity information" would be defined as any of the following information: a Social Security number, driver's license number, any financial account information (such as savings or checking account numbers; credit, debit, or electronic funds transfer card numbers or any other financial transaction device account numbers; or certificates or account numbers for stocks or other securities), or any personal identification numbers (PIN) for any of the previously described accounts.
