A SUMMARY OF HOUSE BILL 4261 AS INTRODUCED 2-11-99


The bill would add a new section to the Penal Code to require that an individual provide a "peace officer" with identification information when lawfully requested. In situations where an individual is legally required to provide an officer with information regarding that individual's identity, the bill would make it a felony for the person to misrepresent his or her identity, lie about not having identification in his or her possession, or to intentionally fail to provide identification. Violation of the bill's provisions would be punishable by imprisonment for up to four years, a fine of no more than $2,000, or both. The bill would define a "peace officer" as any of the following:


1) a police officer of the state or of a political subdivision of the state,


2) a county sheriff or his or her deputy,


3) a conservation officer, or


4) a police officer of a community college, college, or university authorized by the community college, college, or university to enforce the state's criminal laws.
