A SUMMARY OF HOUSE BILL 4327 AS INTRODUCED 2-23-99


House Bill 4327 would amend the act that prohibits the dissemination of sexually explicit materials to minors. The bill would prohibit a manager of a business enterprise that sells sexually explicit visual or verbal materials from displaying that material unless it is done in a restricted area. The bill would define "restricted area" to mean any of the following: an area behind a counter if access is limited only to employees who are not minors and the material is displayed so as to prevent the view of the lower two-thirds of the cover; a building or a distinct signed area in a building if access by minors is prohibited and monitored; or, an area whose perimeter is at least 75 percent walled and whose point of access is signed to provide prominent notice that minors are not allowed to enter.


The bill also would define "display"; replace "distribute" with the word "disseminate" and define that term; and, replace the phrase "obscene matter" with "sexually explicit matter."
