A SUMMARY OF HOUSE BILL 4515 AS INTRODUCED 4-20-99


The bill would create a new act to allow an individual who had entered into a contract with a fitness center to be able to revoke the contract within a specified time period. Under the bill, the owner or operator of a fitness center could not require a person to sign a fitness center consumer contract unless the first page of the contract conspicuously contained a provision stating that, after signing the contract, the individual was entitled to revoke the contract within 30 days or within the first three visits, whichever was earlier. A contract that was not in compliance with the bill would be void.


"Fitness center" would refer to a for-profit facility with on-site programs or equipment for aerobic or anaerobic training and enhancement of physical strength, but would not include public or private secondary schools, trade or vocational schools, community colleges, or universities; health or fitness facilities or spas located in a residential complex and used by residents and their guests; hotel health or fitness facilities or spas; or physical therapy facilities. A "fitness center consumer contract" would be a contract between a fitness center and a consumer for the consumer's use of the center's facilities. "Visit" would be defined as a consumer's use of a fitness center's facilities on a single calendar day.
