A SUMMARY OF HOUSE BILL 4683 AS INTRODUCED 5-18-99


Under the Land Division Act, when a person sells a parcel of unplatted land, the deed must contain a statement indicating whether the deed is conveying the right to make further divisions of land exempt from the act's platting requirements. If the deed does not include such a statement, the right to make divisions stays with the remainder of the parent tract or parent parcel retained by the grantor. The bill would provide that the requirements for specifically indicating that a transfer of land included the right to make further divisions would not apply to transfers of a deed that occurred upon the completion of the terms of a land contract or other written agreement that was entered prior to March 31, 1997 (the effective date of the Land Division Act).
