A SUMMARY OF HOUSE BILL 4731 AS INTRODUCED 5-25-99


The bill would authorize the Department of Natural Resources (DNR) to convey property that is under its jurisdiction in Gerrish Township, Roscommon County, for $1, which would be credited to the general fund. The bill would specify that the property would have to be used exclusively for public recreational purposes, and that, upon termination of that use, the state could repossess it. Further, if the grantee disputed the state's exercise of its right of reentry and failed to promptly deliver possession, the attorney general could bring an action to quiet title to the property.


The bill would also specify that the conveyance would be by quitclaim deed, approved by the attorney general, and would convey all coal, oil, gas, and other mineral rights held by the state, excluding sand, gravel, clay, or other nonmetallic minerals found on or under the property.
