A SUMMARY OF HOUSE BILL 5192 AS INTRODUCED 12-9-99


Part 115 of the Natural Resources and Environmental Protection Act (NREPA), which regulates solid waste management, specifies that a solid waste disposal area may not be operated without a license from the Department of Environmental Quality (DEQ), and may not be operated contrary to an approved solid waste management plan, or contrary to a permit, license, or final order issued under the provisions of the act. House Bill 5192 would amend Part 115 to specify that, in addition, a disposal area could not be operated contrary to a judicial determination. The bill would also delete conflicting provisions in Part 115 of the act concerning the fees which must accompany an application to operate a disposal area.
