A SUMMARY OF HOUSE BILL 5268 AS INTRODUCED 3-2-2000


The bill would amend the Natural Resources and Environmental Protection Act to limit to $100 the permit fees charged to nonprofit entities by the Department of Environmental Quality for certain projects involving the use of land and water (i.e., construction or expansion of a marina, performing construction work in certain areas near water, using chemicals to control "aquatic nuisances", and the like).


Currently the statute specifies fees ranging from $50 for minor projects and seasonal dam drawdowns and reflooding, to $1,500 for large marina projects, to $2,000 for major projects involving dredging, filling, building seawalls and bulkheads, filling or draining of wetlands, dredging in areas of suspected contamination, shore projections, new commercial docks or wharves, stream enclosures or replacements, new golf courses, subdivisions, and condominiums. All of these fees are scheduled to be reduced to $25 beginning October 1, 2003.


Under the bill, if a nonprofit entity applied for a permit for one of the projects listed above, the application fee charged could not exceed $100.
