A SUMMARY OF HOUSE BILL 5269 AS INTRODUCED 2-3-00

House Bill 5269 would amend the Liquor Control Code (MCL 436.1105 et al.) to allow the sale and consumption of wine and brandy on or off a manufacturer's premises. Currently, the act specifies that the Liquor Control Commission (LCC) may approve a brandy manufacturer (who, under the act, must be either a licensed or small wine maker) to sell its brandy at its licensed premises, or at other premises authorized under the act. The act also specifies that a wine maker or brandy manufacturer may sell the wine or brandy in a restaurant, for consumption on or off the premises, if the restaurant is owned by the wine or brandy maker or operated by another person under an agreement approved by the LCC and located on the premises. House Bill 5269 would specify, instead, that brandy and wine could be sold for consumption on or off the licensed premises. The bill would also delete the requirement that LCC approval be required in any of these instances.
