A SUMMARY OF HOUSE BILL 5466 AS INTRODUCED 2-29-00


House Bill 5466 would amend the Michigan Vehicle Code to ensure name change confidentiality under certain circumstances. Currently the probate courts of the state report all name changes they authorize to the secretary of state. House Bill 5466 would place this responsibility with the family divisions of the circuit courts which have replaced the probate courts. Further, the bill specifies that if the family division of circuit court makes a name change record confidential under section 3 of chapter 11 of the probate code, the secretary of state could not disclose information to reveal the fact that an individual had changed his or her name. (Section 3 of chapter 11 of the probate code is a new section of the code proposed by House Bill 5044 which would give a judge the discretion to determine the need to publish a name change when a person had requested confidentiality.) House Bill 5466 is tie-barred to House Bill 5044 and could not become law unless that bill also were enacted.
