A SUMMARY OF HOUSE BILL 5708 AS INTRODUCED 5-2-00


House Bill 5708 would amend the Metropolitan Councils Act to change the definitions of "qualified city", and of "qualified county", and in doing so, expand the creation of metropolitan region councils.


Under the law, "qualified city" is defined to mean a city that meets all of the following conditions: (i) the city is located in a participating qualified county; (ii) the city owns two or more regional cultural institutions; and, (iii) the city has a population of not less than 700,000 persons according to the most recent federal decennial census. House Bill 5708 would retain only the condition that a city own two or more regional cultural institutions, and remove the conditions that specify a city's minimum population, and its location in a participating qualified county.


The law also defines "qualified county" to mean a county that meets the following requirements: (i) the county has a population of not less than 780,000 according to the most recent federal decennial census; and, (ii) the county has a qualified city within its geographic boundaries, or is contiguous to a county with a qualified city. House Bill 5708 would retain only the condition that a qualified county have a qualified city within its geographic boundaries or is contiguous to a county with a qualified city, and would remove the condition that specifies the county's minimum population.


Finally, under current law, two or more qualified counties in combination with one another and with one or more qualified cities may form a metropolitan region council by adopting articles of incorporation, if the appropriate county commission(s) and city council(s) adopt resolutions and articles of incorporation. House Bill 5708 specifies instead that two or more qualified counties in combination with one another and with one or more qualified cities "that is in one of the qualified counties"could form a metropolitan region council, in the same manner.
