A SUMMARY OF HOUSE BILLS 5730 AND 5731 AS INTRODUCED 5-4-00


Currently, under the Michigan Penal Code, someone who commits larceny by stealing another person's firearm is guilty of a felony punishable by imprisonment for up to 5 years or a fine of up to $2,500, or both.


House Bill 5730 would amend the Michigan Penal Code (MCL 750.357b) to prohibit suspending a sentence imposed for committing larceny by stealing a firearm, and House Bill 5731 would amend the Code of Criminal Procedure (MCL 777.16r) to remove the crime of "larceny - stealing the firearm of another" from the sentencing guidelines (to reflect a penalty allowing no judicial discretion).
