A SUMMARY OF HOUSE BILL 5872 AS INTRODUCED 6-6-00


House Bill 5872 would add a new section to Part 303 of the Natural Resources and Environmental Protection Act (324.30311a), concerning the protection of wetlands, to prohibit the Department of Natural Resources (DNR) from requiring that a permit applicant grant a conservation easement on land that was not subject to the permit. Further, if, after the effective date of the bill, a court determined that the DNR had acted in violation of this provision, then the department would have to pay the person who granted the easement the easement's fair market value.
