A SUMMARY OF HOUSE BILL 5960 AS INTRODUCED 9-26-00

The bill would move up the deadline for the submission of nominating petitions for incumbent partisan candidates to put their names on primary election ballots.

More specifically, the bill would amend the Michigan Election Law to require incumbent candidates to file nominating petitions for primary elections by the sixteenth (instead of the twelfth) Tuesday before the August primary election. The current deadline (the twelfth Tuesday before the August primary election) would be kept for non-incumbent candidates. (In the case of city primary elections held on the third Monday in February, the bill also would require incumbent candidates to file their nominating petitions no later the 4 p.m. of the eleventh Monday before the February election date, while retaining the current deadline of the seventh Monday before the February primary election for non-incumbent candidates.)

The bill would amend the sections of the act that apply to nominating petitions and withdrawal of candidates' names for all of the following offices: governor, United States senator, United States representative, state senator, state representative, county office (county clerk, treasurer, register of deeds, prosecuting attorney, sheriff, drain commissioner, surveyor, "coroner," auditor, road commissioner), city office, and township office.
