A SUMMARY OF HOUSE BILL 6094 AS INTRODUCED 11-9-00


The bill would amend the Public Health Code to require nursing homes that have a policy prohibiting the use of safety rails on hospital-type beds to give each resident who uses that type of bed the option of using safety rails. New residents would have to be offered this option, and other residents could have the option upon request. However, if a resident or his or her legal representative chose to use safety rails, the nursing home would be allowed to require the resident or legal representative to sign a statement waiving the resident's right to file a civil action for damages for an injury caused by the use of the bed rails (except injuries caused by nursing home staff negligence).
