NOTIFICATION OF CHILD CARE CENTERS - S.B. 738: COMMITTEE SUMMARY

CONTENT
The bill would amend the child care licensing Act to require that the Family Independence Agency (FIA) establish, maintain, and periodically update a comprehensive list of "children's products" that had been recalled by an agency of the Federal government or the products' manufacturer, distributor, or importer.
The FIA would have to provide a copy of the list to all of the following:
-- A child care organization licensed or registered in Michigan.
-- A person receiving a subsidy from the FIA child care funds.
-- Any other person or entity the FIA considered appropriate.
"Children's product" would mean a product, including a crib, bed, car seat, chair, bath seat, child gate, play yard, stationary activity center, carrier, stroller, walker, swing, toy, or play equipment, that was designed or intended for the care of or use by children under six years of age or both children under six and older than six and that was designed or intended to come into contact with a child while the product was being used.
A product would not be considered a "children's product" if either of the following applied:
-- It could be used by or for the care of a child under six, but was designed or intended for used by the general population or segments of the general population, and not solely or primarily for use by a child or for the care of a child.
-- It was a medication, drug, or food, or was intended to be ingested.

FISCAL IMPACT
The bill would have no fiscal impact on State or local government. It appears that the cost of acquisition and provision of the information could be absorbed within current department administration spending.
