CONTENT
The bill would amend Public Act 369 of 1974, which regulates driver training schools, to permit the Department of State to issue a license certificate to an applicant for a driving instructor's license after a favorable criminal history check had been completed by the Department of State Police, but on the condition that the license would be canceled or revoked if the criminal history check from the Federal Bureau of Investigation (FBI) revealed that the applicant did not satisfy the qualifications for a license. The Department of State immediately would have to notify the driver training school licensee, which would have to require the applicant to surrender the license certificate.
Under the Act, a driver training school licensee may not continue to employ a person as a driving instructor before requesting and receiving at least once every two years from the State Police and the FBI a criminal history check on the person. The bill would lengthen the interval between criminal history checks to at least once every five years.
