DRIVING INSTRUCTOR RECORDS - H.B. 4008 (H-1): COMMITTEE SUMMARY

House Bill 4008 (Substitute H-1 as passed by the House)

Sponsor: Representative Ron Jelinek

House Committee: Regulatory Reform

Senate Committee: Transportation and Tourism

Date Completed: 5-16-00

CONTENT

The bill would amend the Michigan Vehicle Code to require a driver training school operator to include in its contract with each client, as prescribed by the Secretary of State, a notice that nonpersonal information related to the driving record of each instructor was available for review by the general public.

The Code currently provides that an operator that advertises the availability of its services to the general public through a written publication or through any electronic or computerized media must include in that advertisement that nonpersonal information related to the driving record information of each instructor is available for review by the general public at the business address of the owner. The bill would replace this provision with the requirement described above.

Currently, an operator that fails to include the required information in its advertising is subject to a fine of up to $500. The bill would retain this penalty for a violation of the revised requirement.
