CONTENT


The bill would amend the Public Health Code to delete a provision under which the Department of Consumer and Industry Services (DCIS) may not grant more than two consecutive waivers of its biennial hospital visits.


Under the Code, the DCIS must make a biennial visit to each hospital for survey and evaluation for the purpose of licensure. The Department may waive the visit if a hospital, as part of a timely application for license renewal, requests a waiver, submits evidence that it is fully accredited, and submits a copy of its most recent accreditation report. The DCIS must grant a waiver if the report is less than two years old and there is no indication of substantial noncompliance with licensure standards or of deficiencies that represent a threat to public safety or patient care in the report, in complaints involving the hospital, or in any other information available to the DCIS. If the accreditation report is two years old or more, the DCIS may extend the hospital's current license until the next accreditation survey is completed; grant a waiver on the condition that the hospital promptly submit the next report to the Department; or deny the waiver request and conduct the required visit.


The Code specifies that the DCIS may not grant more than two consecutive waivers under these provisions. The bill would delete that limitation.
