NURSING HOME SURVEY - H.B. 5460 (S-2): FLOOR ANALYSIS

CONTENT


The bill would amend the Public Health Code to revise the Code's current provisions regarding inspections of and visits to nursing homes by the Department of Consumer and Industry Services (DCIS).


Currently, under the Code, the DCIS must make annual and other visits to each licensed health facility and agency for the purpose of surveying, evaluating, and consulting with the facility. The bill would do the following:


-- Beginning 12 months after the effective date of the bill, require the Department to assure that each newly hired nursing home surveyor, before beginning oversight responsibilities and as part of his or her basic training, was assigned full-time to a licensed nursing home for at least 10 days to observe operations of the home outside of the survey process.

-- Require the DCIS semiannually to provide for joint training with nursing home surveyors and providers on at least one of the 10 most frequently issued Federal citations in Michigan during the past year; develop a protocol for review of the citation patterns compared to regional outcomes, standards, and complaints regarding the nursing home survey process; and report to the Legislature on the review.

-- Require each licensed health professional who was a member of a DCIS nursing home survey team to earn at least 50% of his or her required continuing education credits (if any) in geriatric care.

-- Prohibit a member of a nursing home survey team from being employed by a nursing home or nursing home management company at the time of the survey.

-- Require the DCIS, in consultation with nursing home provider groups, the Department of Community Health, the State long-term care ombudsman, and the Federal Health Care Finance Administration to clarify certain terms used in Federal law and applied by DCIS "to provide more consistent regulation of nursing homes".

-- Require that the DCIS report to the Legislature on initial and follow-up surveys conducted on all nursing homes and specify the content of the report.
