ROAD ABANDONMENT - H.B. 5940 (H-2): FLOOR ANALYSIS

CONTENT
The bill would amend Public Act 283 of 1909, which governs public highways and private roads, to require a board of county road commissioners, if it determined to abandon any county road or a portion of a county road to a township, to quitclaim deed the property if the interest were nontransferable to the township. The township would have to retain the property or allow it to revert to the adjoining landowners.
These requirements would be subject to the Act's provisions allowing landowners to submit a petition seeking abandonment of a road, and requiring the board of county road commissioners to notify nearby landowners or occupants of a hearing on the petition. Under the bill, the county board also would have to serve notice on the board of the township in which the road was situated. The township board would have first priority to retain the property or portion of the property.

FISCAL IMPACT
Townships do not have jurisdiction over roads and receive no funding under Public Act 51 of 1951. Therefore, the bill would have no fiscal impact on the distribution of State revenues.
