A bill to amend 1939 PA 280, entitled "The social welfare act," by amending section 1c (MCL 400.1c). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1c. (1) A person AN INDIVIDUAL employed by the 2 department of social services at the W.J. Maxey campus in 3 Whitmore lake or any of its affiliated facilities, at the Adrian 4 training school in Adrian, the Arbor Heights center in Ann Arbor, 5 Camp Nokomis in Prudenville, Camp Shawano in Grayling, or a simi- 6 lar facility under the jurisdiction of the department established 7 or funded by the state after the effective date of this section, 8 FAMILY INDEPENDENCE AGENCY who is injured during the course of 9 his or her employment as a result of an assault by a recipient of 10 social BENEFITS OR services UNDER THIS ACT, BY AN INDIVIDUAL 11 ACTING IN CONCERT WITH OR AT THE DIRECTION OF SUCH A RECIPIENT, 00714'99 DAM 2 1 BY AN INDIVIDUAL WHO IS AN APPLICANT FOR BENEFITS OR SERVICES 2 UNDER THIS ACT OR WHO IS THE SUBJECT OF AN INVESTIGATION BY THE 3 FAMILY INDEPENDENCE AGENCY BEING CONDUCTED UNDER THIS ACT OR 4 OTHER STATE OR FEDERAL LAW, OR BY AN INDIVIDUAL ACTING IN CONCERT 5 WITH OR AT THE DIRECTION OF SUCH AN INDIVIDUAL shall receive his 6 or her full wages by FROM the state department FAMILY INDE- 7 PENDENCE AGENCY until worker's compensation benefits begin and 8 then shall receive in addition to worker's compensation benefits 9 a supplement from the state department which FAMILY INDEPEN- 10 DENCE AGENCY THAT, together with the worker's compensation bene- 11 fits, shall equal but not exceed the weekly net wage of the 12 employee at the time of the injury. This supplement shall only 13 apply APPLIES while the person INDIVIDUAL is on the state 14 department's FAMILY INDEPENDENCE AGENCY'S payroll and is receiv- 15 ing worker's compensation benefits. and shall include an 16 employee who is currently receiving worker's compensation due to 17 an injury covered by this section. Fringe benefits normally 18 received by an employee shall be REMAIN in effect during the 19 time the employee receives the supplement provided by this 20 section SUBSECTION from the department FAMILY INDEPENDENCE 21 AGENCY. 22 (2) Subsection (1) shall apply APPLIES whether the 23 employee was directly assaulted or was assaulted as a result of 24 aiding another employee in subduing a recipient. 00714'99 Final page.
