        A bill to amend 1893 PA 118, entitled

   "An act to revise and consolidate the laws relative to state
   prisons, to state houses of correction, and branches of state
   prisons and reformatories, and the government and discipline
   thereof and to repeal all acts inconsistent therewith,"

   (MCL 800.33 to 800.62) by amending the title and by adding sec-

   tion 40.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to  revise and consolidate the laws relative to state

 3     prisons, to state houses of correction, and branches of state

 4     prisons and reformatories, and the government  REGULATE THE

 5    CONDUCT and discipline  thereof and to repeal all acts inconsis-

 6     tent therewith  OF PRISONERS IN STATE CORRECTIONAL FACILITIES AND

 7    TO MAKE CERTAIN PROVISIONS REGARDING THE OPERATION OF

 8    CORRECTIONAL FACILITIES; AND TO PROVIDE PENALTIES.

 1         SEC. 40.  (1) A PRISONER UNDER THE JURISDICTION OF THE

 2    DEPARTMENT OF CORRECTIONS SHALL NOT ASSAULT OR BATTER AN EMPLOYEE

 3    OF THE DEPARTMENT WITH BLOOD, FECES, URINE, SALIVA, OR OTHER

 4    BODILY FLUID OR EMISSION.

 5         (2) A PRISONER WHO VIOLATES THIS SECTION IS GUILTY OF A MIS-

 6    DEMEANOR PUNISHABLE BY IMPRISONMENT FOR NOT MORE THAN 90 DAYS OR

 7    A FINE OF NOT MORE THAN $100.00, OR BOTH.
