HOUSE BILL No. 4574 April 27, 1999, Introduced by Reps. Gilbert, Kowall and Birkholz and referred to the Committee on Tax Policy. A bill to amend 1977 PA 289, entitled "An act to provide for payments to municipalities for fire pro- tection services received by state facilities; to prescribe the powers and duties of certain state and local agencies and offi- cials; and to authorize the proration of certain appropriations," by amending sections 3 and 4 (MCL 141.953 and 141.954). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 3. (1) By September 1 of each year, a municipality in 2 which a state facility is located shall submit to the director 3 the following: 4 (a) The dollar amount of the actual expenditures for fire 5 protection for the municipality's preceding fiscal year. 6 (b) The current state equalized valuation. 7 (C) THE DOLLAR AMOUNT OF SPECIAL ASSESSMENTS LEVIED ON 8 PUBLIC PROPERTY OF THIS STATE AND COLLECTED DURING THE 9 MUNICIPALITY'S PRECEDING FISCAL YEAR UNDER THE TOWNSHIP AND 02131'99 c TMV 2 1 VILLAGE PUBLIC IMPROVEMENT AND PUBLIC SERVICE ACT, 1923 PA 116, 2 MCL 41.411 TO 41.419, FOR PURCHASING FIRE APPARATUS AND EQUIPMENT 3 OR CONSTRUCTING AND MAINTAINING HOUSING FACILITIES FOR FIRE APPA- 4 RATUS AND EQUIPMENT. 5 (D) THE DOLLAR AMOUNT OF SPECIAL ASSESSMENTS LEVIED ON 6 PUBLIC PROPERTY OF THIS STATE AND COLLECTED DURING THE 7 MUNICIPALITY'S PRECEDING FISCAL YEAR UNDER 1951 PA 33, MCL 41.801 8 TO 41.813, FOR PURCHASING AND HOUSING EQUIPMENT AND OPERATING 9 EQUIPMENT FOR A FIRE DEPARTMENT. 10 (E)(c)Certification that fire protection is provided to 11 a state facility in the same manner as those services are pro- 12 vided to the municipality. 13 (2) Informationon fire protection expenditures and state14equalized valuationREQUIRED UNDER SUBSECTION (1)(A) TO (D) 15 shall be submitted in a form prescribed by the director. 16 (3) The director shall review the data submitted and, before 17 November 1 of each year, shall certify to the state treasurer an 18 amount, determined pursuant to the formula set forth in section 19 4, to be paid to a municipality in which a state facility is 20 located. 21 (4) The state treasurer shall draw a warrant upon the gen- 22 eral fund of the state for the amount certified to be paid to a 23 municipality and shall forward the warrant to the treasurer of 24 the municipality before December 1 of each year., except as25provided in section 2(1).26 Sec. 4. (1) The amount due the municipality shall be 27 determined by dividing the estimated equalized value of the state 02131'99 c 3 1 facilities located in the municipality by the sum of the state 2 equalized valuation of the municipality and the estimated equal- 3 ized value of the facilities,andmultiplying the result by the 4 fire protection expenditures of the municipality reported to the 5 director pursuant to section 3(2), AND SUBTRACTING FROM THE PRO- 6 DUCT THE SUM OF THE AMOUNTS REQUIRED TO BE REPORTED UNDER 7 SECTION 3(1)(C) AND (D). 8 (2) A payment shall not be made to a municipality if the 9 amount of the payment is less than $500.00, if the estimated 10 equalized value of the state facility in the municipality is less 11 than 1% of the amount of the state equalized valuation of the 12 municipality, or if the state facility provides its own fire 13 protection. 14 Enacting section 1.
