A bill to amend 1909 PA 283, entitled "An act to revise, consolidate, and add to the laws relating to the establishment, opening, discontinuing, vacating, closing, altering, improvement, maintenance, and use of the public high- ways and private roads; the condemnation of property and gravel therefor; the building, repairing and preservation of bridges; maintaining public access to waterways under certain conditions; setting and protecting shade trees, drainage, and cutting weeds and brush within this state; providing for the election or appointment and defining the powers, duties, and compensation of state, county, township, and district highway officials; and to prescribe penalties and provide remedies," by amending section 7 (MCL 224.7). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 7. (1)AnyA person elected or appointed TO THE 2 OFFICE OF county road commissioner shall, within 10 days after 3 being notified in writing by the clerk ofsuchTHE county of 4 his OR HER election or appointment, take and subscribe the 5 constitutional oath of office and filethe sameIT withsaid6 THE COUNTY clerk.Each and everyA county road commissioner 02503'99 TMV 2 1 shallbe required toexecute and give AN official bond in 2suchTHE amountasTHAT the COUNTY board ofsupervisors of3suchCOMMISSIONERS OF THE countymay determine, the4 DETERMINES. THE expense of securingsuchTHE bond, if any, 5toSHALL be paid from the county road fund. The term of office 6 of the first commissioners elected or appointed inanyA county 7 under this act,shall commence immediately upon filingsuch8 THE oath of office and bond., and shall continue as herein9provided. The successor to each such commissioner shall be10elected at the general election on the first Tuesday after the11first Monday in November preceding the expiration of his term.12TheyTHE FIRST COMMISSIONERS shall hold office for 2, 4, and 6 13 years respectively, from thesaidfirst day of January.; and14thereafterSUBSEQUENTLY, 1 commissioner shall be elected or 15 appointed biennially BEFORE THE EXPIRATION OF A TERM, for the 16 full term of 6 years, EXCEPT AS PROVIDED IN SUBSECTION (2).No17member of the board of supervisors shall be eligible toA MEMBER 18 OF THE COUNTY BOARD OF COMMISSIONERS IS NOT ELIGIBLE FOR the 19 office of county road commissioner, andsuchTHOSE offices 20 shall not be held by the same person at the same time. 21 (2) AFTER THE EFFECTIVE DATE OF THE AMENDATORY ACT THAT 22 ADDED THIS SUBSECTION, A COUNTY ROAD COMMISSIONER SHALL BE 23 ELECTED OR APPOINTED TO A TERM OF 4 YEARS. 24 Enacting section 1. This amendatory act does not take 25 effect unless Senate Bill No. _____ or House Bill No. _____ 26 (request no. 02503'99 a) of the 90th Legislature is enacted into 27 law. 02503'99
