HOUSE BILL No. 4696


     May 18, 1999, Introduced by Reps. Kowall, Pappageorge, Bishop, Gosselin, Mortimer,
Kukuk, LaSata, Koetje, Shulman and Raczkowski and referred to the Committee on
Conservation and Outdoor Recreation.


        A bill to amend 1965 PA 7, entitled

   "An act to authorize the department of conservation to sell cer-
   tain lands and buildings located thereon owned by the department
   of conservation in the township of Waterford, Oakland county; and
   to provide for the disposition of the revenue received
   therefrom,"

   by amending section 2 and by adding section 2a.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 2.  The conveyance authorized by this act shall be by

 2    quitclaim deed approved by the attorney general.  with the
             provi-

 3     sion that when the property is no longer used for
                       conservation

 4     education and related purposes, it shall revert to the
                       state. 

 5         SEC. 2A.  THE CONVEYANCE ENTERED INTO PURSUANT TO SECTION 2

 6    SHALL BE AMENDED TO PROVIDE FOR BOTH OF THE FOLLOWING:

 7         (A) THE RESTRICTION AND POSSIBILITY OF REVERTER CREATED IN

 8    THAT CONVEYANCE SHALL BE ELIMINATED.

 1         (B) IF THE GRANTEE OFFERS FOR SALE ALL OR ANY PART OF THE

 2    PROPERTY, THE DEPARTMENT OF NATURAL RESOURCES SHALL HAVE THE

 3    FIRST RIGHT TO PURCHASE THAT PROPERTY FOR FAIR MARKET VALUE AS

 4    DETERMINED BY AN APPRAISAL BY THE STATE TAX COMMISSION OR AN

 5    INDEPENDENT FEE APPRAISER BASED ON THE PROPERTY'S HIGHEST AND

 6    BEST USE.
