A bill to amend 1984 PA 44, entitled "Motor fuels quality act," by amending section 4 (MCL 290.644), as amended by 1986 PA 127. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 4. (1) A retail dealer shall not transfer, sell, dis- 2 pense, or offer gasoline for sale in this state unless the pump 3 dispensing the gasoline is posted with a notice, as provided in 4 subsection (2), that indicates the grade of gasoline and the 5 additives in the gasoline that are dispensed from the pump.If6the gasoline contains at least 1% alcohol by volume, the notice7shall state: "Contains (indicate the type of alcohol such as8ethanol or methanol, and if methanol the label shall state9"alcohol: methanol", followed, in the same size type, by the10concentration to the nearest whole percent)". However, if the11gasoline contains alcohols or ethers that have a molecular weight03709'99 TJS 2 1greater than ethanol and are not mixed with methanol or ethanol,2or both, those alcohols or ethers are not subject to the notice3requirement of this section.4 (2) The director shall design a uniform means of providing 5 the notice required by subsection (1). The notice shall be 6 designed in such a manner that the consumer can readily identify 7 the grade of gasoline and the additives in the gasoline. The 8 notice shall include a statement indicating that the gasoline 9 dispensed from the pump meets the quality and purity standards 10 established by the laws of this state and indicating the number 11 of the 24-hour toll free consumer hot line maintained pursuant to 12 section 7(2). 13 (3) The director shall include the design for the uniform 14 notice required by this section in a rule promulgatedpursuant15to Act No. 306 of the Public Acts of 1969, being sections 24.20116to 24.315 of the Michigan Compiled LawsUNDER THE ADMINISTRATIVE 17 PROCEDURES ACT OF 1969, 1969 PA 306, MCL 24.201 TO 24.328. 18 (4) A person who violates this section or rules promulgated 19pursuant toUNDER this section is liable for a civil fine not 20 to exceed $1,000.00 for eachand everyday of the continuance 21 of the violation. A civil fine orderedpursuant toUNDER this 22 section shall be submitted to the state treasurer for deposit in 23 the gasoline inspection and testing fund created by section 8. 24(5) Subsection (1) shall not apply until 90 days after the25rule required by subsection (3) is promulgated.03709'99 Final page.
