        A bill to amend 1961 PA 236, entitled

   "Revised judicature act of 1961,"

   by amending section 2538 (MCL 600.2538), as added by 1993 PA

   189.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 2538.  (1) For services provided  which 
             THAT are not

 2    reimbursable under the provisions of  the federal social
             security

 3     act, Title IV-D  PART D OF TITLE IV OF THE SOCIAL
                       SECURITY ACT,

 4    CHAPTER 531, 49 STAT. 620, 42 U.S.C. 651 TO 655, 656 TO 660, AND

 5    663 TO 669b, every person required to make payments of support or

 6    maintenance to be collected by the friend of the court OR THE

 7    STATE DISBURSEMENT UNIT shall pay a fee of $1.25 per month for

 8    every month or portion of a month that support or maintenance is

 9    required to be paid.  The fee shall be paid monthly, quarterly,

10    or semiannually as required by the friend of the court.  The

 1    friend of the court shall provide notice OF THE FEE REQUIRED BY

 2    THIS SECTION to the person ordered to pay the support  money
             of

 3     the fee required by this section  and that the fee
                       shall be paid

 4    monthly or as otherwise determined by the friend of the court.

 5     Except as provided in subsection (2), each fee collected
             shall

 6     be transmitted to the county treasurer.  Of each fee
                       collected,

 7     the county treasurer shall credit 25 cents to the general
                       fund of

 8     the county,  THE FRIEND OF THE COURT OR SDU SHALL
                       TRANSMIT 25

 9    CENTS OF EACH FEE COLLECTED UNDER THIS SECTION TO THE APPROPRIATE

10    COUNTY TREASURER FOR DEPOSIT INTO THE GENERAL FUND OF THE COUNTY

11    and shall transmit the balance to the state treasurer for deposit

12    in the state court fund created in section 151a.

13         (2)  In the third circuit court, each fee collected
             shall be

14     transmitted to the state treasurer.  The state treasurer
                       shall

15     deposit 25 cents in the general fund, and shall deposit the
                       bal-

16     ance of each fee in the state court fund created in

17     section 151a.  AS USED IN THIS SECTION, "STATE
                       DISBURSEMENT UNIT"

18    OR "SDU" MEANS THE ENTITY ESTABLISHED IN SECTION 6 OF THE OFFICE

19    OF CHILD SUPPORT ACT, 1971 PA 174, MCL 400.236.

20         Enacting section 1.  This amendatory act does not take

21    effect unless Senate Bill No. _____ or House Bill No. _____

22    (request no. 03398'99) of the 90th Legislature is enacted into

23    law.
