        A bill to amend 1978 PA 328, entitled

   "Food processing act of 1977,"

   by amending section 5 (MCL 289.805).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 5.  (1) The director shall promulgate rules necessary

 2    to administer this act pursuant to  Act No. 306 of the
             Public

 3     Acts of 1969, as amended, being sections 24.201 to 24.315
                       of the

 4     Michigan Compiled Laws  THE ADMINISTRATIVE
                       PROCEDURES ACT OF

 5    1969, 1969 PA 306, MCL 24.201 TO 24.328.  Such 

 6         (2) THE rules DESCRIBED IN SUBSECTION (1) shall include

 7     criteria  AT LEAST THE FOLLOWING:

 8         (A) CRITERIA for annual certification of health departments.

 9     , annual 

10         (B) ANNUAL review of the compliance of a certified health

11    department.  , and revocation

 1         (C) REVOCATION of certification if a local health department

 2    is not in compliance with state standards for certification.

 3         (D) THE ESTABLISHMENT OF AN ANTI-LISTERIA PROGRAM NOT LATER

 4    THAN JANUARY 1, 2002, TO INCLUDE AT LEAST IRRADIATION AND

 5    PASTEURIZATION.
