A bill to amend 1917 PA 273, entitled "An act to regulate and license pawnbrokers in cities and incor- porated villages of this state, having a population of more than 3,000," by amending section 5 (MCL 446.205), as amended by 1998 PA 233. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 5. (1) A pawnbroker shall keep a record in which is 2 written in English, at the time the pawnbroker receives any arti- 3 cle of personal property or other valuable thing by way of pawn, 4 a description of the article, a sequential transaction number, 5 any amount of money loaned thereon, the name, residence, general 6 description, and driver license number, official state personal 7 identification card number, or government identification number 8 of the person from whom the article was received, and the day and 9 hour when the article was received. The record, the place where 10 the business is carried on, and all articles of property in that 04215'99 LBO 2 1 place of business are subject to examination at any time by the 2 city attorney, local police agency, the county prosecuting attor- 3 ney of the county in which the city or village is situated, or 4 the department of state police. 5 (2) Upon the receipt of any article of personal property or 6 other valuable thing by way of pawn, the pawnbroker shall make a 7 permanent record of the transaction on a form provided by the 8 pawnbroker that substantially complies with the form described in 9 subsection (4). Each record of transaction shall be completed in 10 duplicate by the pawnbroker, legibly in the English language, and 11 shall contain all applicable information required to complete the 12 record of transaction form under subsection (4).This subsec-13tion does not prohibit the use and transmission of theBEGINNING 14 12 MONTHS AFTER THE EFFECTIVE DATE OF THE AMENDATORY ACT THAT 15 AMENDED THIS SUBSECTION, THE information required in the record 16 of the transaction SHALL BE ACCESSIBLE TO LOCAL POLICE AGENCIES 17 by means of computer or other electronic media.as permitted by18the local police agency within the applicable local unit of19government.20 (3) The pawnbroker shall retain a record of each transaction 21 and, within 48 hours after the property is received, shall send 1 22 copy of the record of transaction to the local police agency. 23 (4) The record of transaction form shall be 8-1/2 inches by 24 11 inches in size and shall be as follows: 04215'99 3 1 RECORD OF TRANSACTION 2 FRONT 3 Article | Serial No. 4 ________________________________ |______________________________ 5 Model No. or Case No. | Lens No. or Move.
