A bill to amend 1978 PA 368, entitled "Public health code," by amending sections 9209 and 9227 (MCL 333.9209 and 333.9227), section 9227 as amended by 1996 PA 540, and by adding section 9208a. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 SEC. 9208A. (1) A PARENT, GUARDIAN, OR PERSON IN LOCO PAR- 2 ENTIS APPLYING TO HAVE A MINOR ADMITTED INTO GRADE 6 SHALL 3 PRESENT TO PUBLIC SCHOOL OFFICIALS, AT THE TIME OF REGISTRATION 4 OR NOT LATER THAN THE FIRST DAY OF SCHOOL, EITHER A COMPLETED 5 IMMUNIZATION STATUS SCREENING SUMMARY FORM AND ANY APPROPRIATE 6 CERTIFICATES OF IMMUNIZATION RECEIVED UNDER SECTION 9206 OR A 7 STATEMENT OF EXEMPTION UNDER SECTION 9215. 02956'99 * CPD 2 1 (2) AN IMMUNIZATION STATUS SCREENING SHALL INCLUDE, AT A 2 MINIMUM, AN IMMUNIZATION ASSESSMENT OF EACH OF THE FOLLOWING FOR 3 THE MINOR UNDERGOING THE SCREENING: 4 (A) HEPATITIS B. 5 (B) TETANUS. 6 (C) DIPHTHERIA. 7 (D) MUMPS, MEASLES, AND RUBELLA. 8 (E) VARICELLA. 9 (F) OTHER IMMUNIZATION INFORMATION AS REQUIRED BY RULE OF 10 THE DEPARTMENT. 11 Sec. 9209. (1) Before November 1 of each year, the princi- 12 pal or administrator of each school shall deliver to the state 13 and local health departments a list of the immunization status at 14 the time of school entry of new entering kindergarten and first 15 grade students, AS DETERMINED UNDER SECTION 9208, AND OF NEW 16 ENTERING SIXTH GRADE STUDENTS, AS DETERMINED UNDER SECTION 9208A. 17 (2) The department shall prescribe minimum percentage levels 18 of immunization for children in a school. 19 (3) As a result of the information collected pursuant to 20 subsection (1), the local health officer shall take appropriate 21 action, including immunization clinics, to raise the immunization 22 level of children entering school to the levels established pur- 23 suant to subsection (2). 24 (4) Before the following February 1, the principal or admin- 25 istrator of each school shall update the list to show the addi- 26 tional immunizations received by each child since entering the 27 school. The reports shall be made on forms provided or approved 02956'99 * 3 1 by the department. A child who enters school in September and 2 who has not completed the immunizations required under section 3 9227 and has not filed an exemption under section 9215 before 4 February 1 shall be excluded from school attendance. A child who 5 enters school at any other time of the school year and who has 6 not completed the immunizations required under section 9227 and 7 has not filed an exemption under section 9215 within 4 months 8 after entrance shall be excluded from school attendance. 9 Sec. 9227. The department shall promulgate rules to imple- 10 ment this part, including, but not limited to, rules governing 11 all of the following: 12 (a) Age periods for immunizations. 13 (b) The minimum ages at which immunization may be 14 commenced. 15 (c) The minimum number of doses required during a specified 16 time period. 17 (d) Minimum levels of immunization for children in school, 18 INCLUDING, BUT NOT LIMITED TO, THE MINIMUM LEVELS OF IMMUNIZATION 19 FOR THE DISEASES ASSESSED UNDER SECTION 9208A(2). 20 (e) Reporting under section 9206(3). 21 (f) The acquisition, maintenance, and dissemination of 22 information contained in the childhood immunization registry 23 established under section 9207. 24 Enacting section 1.
