A bill to amend 1976 PA 451, entitled "The revised school code," by amending section 1177 (MCL 380.1177), as amended by 1996 PA 399. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1177. (1) A child enrolling in a public or nonpublic 2 school for the first time OR ENROLLING IN GRADE 6 FOR THE FIRST 3 TIME shall submit 1 of the following: 4 (a) A statement signed by a physician that the child has 5 been tested for and immunized or protected against diseases spec- 6 ified by the director of THE DEPARTMENT OF community health. 7 (b) A statement signed by a parent or guardian to the effect 8 that the child has not been immunized because of religious 9 convictions or other objection to immunization. 00341'99 * TAV 2 1 (c) A statement signed by a physician that certifies that 2 the child is in the process of complying with all immunization 3 requirements. 4 (2) In addition, the parent or guardian of each enrolling 5 child ENROLLING IN KINDERGARTEN FOR THE FIRST TIME shall submit a 6 statement signed by a district, county, or city health department 7 director stating that the child has been administered the depart- 8 ment of community health preschool vision screening test, or 9 signed by a licensed medical or osteopathic physician or a 10 licensed optometrist stating that the child's eyes have been 11 examined during the preschool years after age 3 and before ini- 12 tial entrance. A vision test is not required if there is a 13 statement signed by a parent or guardian to the effect that the 14 child cannot be submitted to the test because of religious 15 convictions. 16 (3) Not later than November 1 of each year, the administra- 17 tor of each school shall provide the director of THE DEPARTMENT 18 OF community health with the immunization status of each pupil in 19 grades K through 12 who enrolled in the school for the first 20 time, OR ENROLLED IN GRADE 6 IN THE SCHOOL FOR THE FIRST TIME, 21 between the immediately preceding January 1 and the immediately 22 preceding September 30, as well as a vision report of each child 23 entering kindergarten during that time period. This information 24 shall be transmitted through the approved local full-time health 25 department, if available, and shall be on forms provided by the 26 director of community health or otherwise reported in a manner 27 approved by the director of THE DEPARTMENT OF community health. 00341'99 * 3 1 Not later than February 1 of each year, the administrator of each 2 school shall provide an update to the report due the previous 3 November 1 to show the immunization status of each pupil in 4 grades K through 12 who enrolled in the school for the first 5 time, OR ENROLLED IN GRADE 6 IN THE SCHOOL FOR THE FIRST TIME, 6 during the calendar year ending the immediately preceding 7 December 31. This information shall be transmitted in the same 8 manner as the report due the previous November 1. 9 (4) The department of community health shall promulgate 10 rules, including rules identifying the diseases specified under 11 subsection (1)(a), for the implementation of this section. 12 Enacting section 1.
