A bill to create the Michigan summer sweep program; to pre- scribe the powers and duties of certain state departments; and to establish a fund and provide for the administration of that fund. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. This act shall be known and may be cited at the 2 "Michigan summer sweep program act". 3 Sec. 2. As used in this act: 4 (a) "Department" means the state transportation department. 5 (b) "Eligible low-income student" means a person who meets 6 all of the following requirements: 7 (i) Is a member of a household the gross annual income of 8 which is equal to or less than the official poverty line for the 9 same size household as defined by the office of management and 10 budget and issued by the United States secretary of health and 06172'00 FDD 2 1 human services pursuant to section 673(2) of the community 2 services block grant act, subtitle B of title VI of the omnibus 3 budget reconciliation act of 1981, 42 U.S.C. 9902. 4 (ii) Is not less than 15 years old and is not more than 17 5 years old. 6 (iii) Is enrolled in high school and is making satisfactory 7 academic progress as determined by his or her grades and his or 8 her scores on the Michigan education assessment program (MEAP) 9 tests administered pursuant to the revised school code, 1976 PA 10 451, MCL 380.1 to 380.1852. 11 Sec. 3. Within 90 days after the effective date of this 12 act, the department shall develop and implement a statewide pro- 13 gram to employ eligible low-income students in street and highway 14 beautification projects. The program shall be known as the 15 "Michigan summer sweep program". 16 Sec. 4. (1) An eligible low-income student may apply to 17 participate in the Michigan summer sweep program by submitting an 18 application to the department on a form prescribed by the 19 department. 20 (2) The department shall develop an application form for the 21 Michigan summer sweep program and shall distribute those applica- 22 tions to all high schools in this state. 23 Sec. 5. (1) The Michigan summer sweep program fund is cre- 24 ated within the state treasury. 25 (2) The state treasurer may receive money or other assets 26 from any source for deposit into the fund. The state treasurer 27 shall direct the investment of the fund. The state treasurer 06172'00 3 1 shall credit to the fund interest and earnings from fund 2 investments. 3 (3) Money in the fund at the close of the fiscal year shall 4 remain in the fund and shall not lapse to the general fund. 5 (4) The department shall expend money from the fund, upon 6 appropriation, only for the purpose of employing eligible 7 low-income students in the Michigan summer sweep program. 06172'00 Final page.
