        A bill to amend 1961 PA 236, entitled

   "Revised judicature act of 1961,"

   by amending section 535 (MCL 600.535), as amended by 1990 PA 54,

   and by adding section 549j.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 535.  (1)  The  EXCEPT AS PROVIDED IN SUBSECTION (2),

 2
      THE thirty-fourth judicial circuit consists of the counties of

 3
      Arenac, Ogemaw, and Roscommon and has  1 judge  2 JUDGES.

 4
       Subject to section 550, the thirty-fourth judicial circuit may

 5
      have 1 additional judge effective January 1, 1991.  If a new

 6
      office of judge is added to this circuit to be filled by election

 7
      in 1990, the term of office of the judge for that election only

 8
      shall be 8 years.

           (2) IF THE COUNTIES OF ARENAC AND OGEMAW APPROVE THE

      REORGANIZATION OF THE THIRTY-FOURTH JUDICIAL CIRCUIT PURSUANT TO

      LAW, AND THE COUNTY OF ROSCOMMON APPROVES THE CREATION OF THE

      FIFTY-EIGHTH JUDICIAL CIRCUIT PURSUANT TO LAW, THE THIRTY-FOURTH

      JUDICIAL CIRCUIT CONSISTS OF THE COUNTIES OF ARENAC AND OGEMAW

 4
      AND HAS 1 JUDGE EFFECTIVE JANUARY 1, 2001.

           SEC. 549J.  IF THE COUNTIES OF ARENAC AND OGEMAW APPROVE THE

      REORGANIZATION OF THE THIRTY-FOURTH JUDICIAL CIRCUIT PURSUANT TO

      LAW, AND THE COUNTY OF ROSCOMMON APPROVES THE CREATION OF THE

      FIFTY-EIGHTH JUDICIAL CIRCUIT PURSUANT TO LAW, THE FIFTY-EIGHTH

      JUDICIAL CIRCUIT CONSISTS OF THE COUNTY OF ROSCOMMON AND HAS 1

      JUDGE EFFECTIVE JANUARY 1, 2001.

           Enacting section 1.  If a new judicial circuit of the cir-

12
      cuit court is created under this amendatory act pursuant to sec-

13
      tion 550a, the change in the composition of the affected judicial

14
      circuits shall take effect for judicial purposes on January 1,

15
      2001.  If the fifty-eighth judicial circuit is created pursuant

16
      to this amendatory act, the incumbent judge of the thirty-fourth

17
      judicial circuit who resides in Roscommon county shall become the

18
      judge of the fifty-eighth judicial circuit on January 1, 2001,

19
      and shall serve until the term for which he or she was elected in

20
      the thirty-fourth judicial circuit expires.
