        A bill to amend 1994 PA 451, entitled

   "Natural resources and environmental protection act,"

   by amending section 11521 (MCL 324.11521).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 11521.  (1) If the owner or operator of a landfill or

 2
      a municipal solid waste incinerator knows or should know that

 3
      solid waste to be disposed of includes yard clippings that are

 4
      generated or collected, or both, on land that is owned by a

 5
      county, municipality, or a state facility, the owner or operator

 6
      of the landfill or municipal solid waste incinerator shall not

 7
      accept the solid waste for disposal.

           (1)  (2) Beginning on March 28, 1995, if  IF the owner or

 9
      operator of a landfill or a municipal solid waste incinerator

10
      knows or should know that solid waste to be disposed of includes

11
      yard clippings,  from any source,  the owner or operator of the

      landfill or municipal solid waste incinerator shall not accept

 2
      the solid waste for disposal.

           (2)  (3)  This section does not apply to  yard  EITHER
   OF

 4
      THE FOLLOWING:

 5
           (A) YARD CLIPPINGS DISPOSED OF FROM NOVEMBER 15 TO APRIL 1

 6
      OF ANY YEAR.

           (B) YARD clippings that are diseased or infested.
