A bill to amend 1982 PA 415, entitled "Correctional officers' training act of 1982," by amending section 12 (MCL 791.512), as amended by 1989 PA 4. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 12. (1) Except as provided for in subsections (2) and 2 (3), a person who is not employed as a state correctional officer 3 on March 30, 1983 and who is not employed as a state correctional 4 officer until after December 31, 1984, shall not be certified or 5 recertified by the Michigan commission of corrections 6 DEPARTMENT unless he or she has done all of the following: 7 (a) Obtained a high school diploma or attained a passing 8 score on the general education development test indicating a high 9 school graduation level. 10 (b) Successfully completed all of the following: 04850'99 DRM 2 1 (i) One of the following: 2 (A) A vocational certificate program as determined by the 3 council, earned from an accredited postsecondary educational 4 institution, which program shall require a minimum of 15 semester 5 credit hours or 23 term credit hours. 6 (B) Equivalent course work to a vocational certificate pro- 7 gram, as determined by the council, earned from an accredited 8 postsecondary educational institution, which course work shall 9 require a minimum of 15 semester credit hours or 23 term credit 10 hours. The credit hours required under this subparagraph may be 11 earned before or after the effective date of the amendatory act 12 that added this subparagraph. 13 (C) A degree granted by an accredited postsecondary educa- 14 tional institution in a major discipline of study that is rele- 15 vant to the position of state correctional officer, as determined 16 by the council. A degree required under this subparagraph may 17 be earned before or after the effective date of the amendatory 18 act that added this subparagraph. 19 (ii) A minimum of 2 months of supervised, paid internship, 20 as determined by the council, as an intern in a correctional 21 facility. 22 (iii) A minimum of 320 hours of new employee training, as 23 determined by the council, at the central training academy. 24 (C) RECEIVED A SATISFACTORY SCORE ON 1 OR MORE PSYCHOLOGICAL 25 FITNESS SCREENING TESTS OF THE TYPE USED IN SCREENING APPLICANTS 26 FOR POSITIONS AS STATE TROOPERS EMPLOYED BY THE DEPARTMENT OF 27 STATE POLICE. THE TEST OR TESTS REQUIRED UNDER THIS SUBDIVISION 04850'99 3 1 SHALL BE APPROVED BY THE COUNCIL AND THE STATE CIVIL SERVICE 2 COMMISSION. 3 (D) (c) Fulfilled other minimum standards and requirements 4 developed pursuant to section 13 by the council and approved by 5 the commission of corrections DEPARTMENT for certification and 6 subsequently for recertification. 7 (2) A person who is employed as a correctional officer or an 8 immediate supervisor of a correctional officer at the former 9 Detroit house of correction on December 31, 1984 shall automati- 10 cally be certified and annually recertified by the Michigan com- 11 mission of corrections DEPARTMENT until December 31, 1985. 12 Beginning January 1, 1986, a person who is employed as a correc- 13 tional officer or an immediate supervisor of a correctional offi- 14 cer at the former Detroit house of correction on December 31, 15 1984 shall not be recertified unless he or she has done both of 16 the following: 17 (a) Completed successfully a minimum of 160 hours of train- 18 ing provided by the department. 19 (b) Fulfilled other minimum standards and requirements for 20 recertification developed pursuant to section 13 by the council 21 and approved by the commission of corrections DEPARTMENT. 22 (3) A department of mental health direct care employee of a 23 state facility officially designated for closure or phase-down 24 due to deinstitutionalization, or a forensic security aide II or 25 III employed by the department of mental health center for foren- 26 sic psychiatry, or a work camp supervisor employed by the 27 department of corrections shall automatically be certified and 04850'99 4 1 annually recertified by the commission of corrections 2 DEPARTMENT for 3 years following the date he or she became 3 employed as a state correctional officer provided he or she has 4 done all of the following: 5 (a) Within 1 year of AFTER the date he or she became 6 employed as a state correctional officer, obtained a high school 7 diploma or attained a passing score on the general education 8 development test indicating a high school graduation level. 9 (b) Within 1 year of AFTER the date he or she became 10 employed as a state correctional officer, completed successfully 11 320 hours of new employee training with a credit up to 160 hours 12 of previously acquired training, as approved by the council. 13 (c) Within 3 years of AFTER the date he or she became 14 employed as a state correctional officer, completed 1 of the 15 following: 16 (i) A vocational certificate program, as determined by the 17 council, earned from an accredited postsecondary educational 18 institution, which program shall require a minimum of 15 semester 19 credit hours or 23 term credit hours. 20 (ii) Equivalent course work to a vocational certificate pro- 21 gram, as determined by the council, earned from an accredited 22 postsecondary educational institution which course work shall 23 require a minimum of 15 semester credit hours or 23 term credit 24 hours. The credit hours required under this subparagraph may be 25 earned before or after the effective date of the amendatory act 26 that added this subparagraph. 04850'99 5 1 (iii) A degree granted by an accredited postsecondary 2 educational institution in a major discipline of study that is 3 relevant to the position of state correctional officer, as deter- 4 mined by the council. A degree required under this subparagraph 5 may be earned before or after the effective date of the amenda- 6 tory act that added this subparagraph. 7 (d) Fulfilled other minimum standards and requirements 8 developed pursuant to section 13 by the council and approved by 9 the commission of corrections DEPARTMENT for certification and 10 subsequently for recertification. 11 (4) All minimum standards and requirements for certification 12 and subsequently for recertification of persons under subsections 13 (1), (2), and (3) shall be ARE subject to approval by the state 14 civil service commission. 04850'99 Final page.
