A bill to amend 1929 PA 199, entitled "An act to authorize and empower villages and townships of this state having a population not exceeding 10,000 inhabitants, to levy a tax for the maintenance or the purchase of lands and main- tenance of property for a community center for the benefit of the public, provided the question of such purchase or maintenance, or both purchase and maintenance, as the case may be, is submitted to the duly qualified voters of such villages or townships and is adopted by a majority vote of those participating in said elec- tion; and to prescribe penalties and provide remedies," by amending sections 3 and 5 (MCL 123.43 and 123.45). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 3. (1) AfteranyA village or townshipshall have2votedVOTES to establish a community center, the governing body 3 ofsuchTHE village or township shall appoint 6 directors 4whichWHO shall hold office until their successors are elected 5 and qualified., and atAT the next regular election there 6 shall be elected a community board of 6 directors, 2 for 1 year, 7 2 for 2 years, and 2 for 3 years,;and THEN annually 06337'00 KDD 2 1thereafterthere shall be elected 2 directors who shall hold 2theiroffice for 3 years or until their successors are elected 3 and qualified. ALTERNATIVELY, THE GOVERNING BODY OF A VILLAGE OR 4 TOWNSHIP MAY BY RESOLUTION PROVIDE THAT AT THE NEXT REGULAR ELEC- 5 TION, AND THEN EVERY 2 YEARS, THERE SHALL BE ELECTED A COMMUNITY 6 BOARD OF 6 DIRECTORS, WHO SHALL HOLD OFFICE FOR 2 YEARS OR UNTIL 7 THEIR SUCCESSORS ARE ELECTED AND QUALIFIED. 8 (2) IF A VILLAGE OR TOWNSHIP INITIALLY ELECTED DIRECTORS FOR 9 3-YEAR TERMS AS DESCRIBED IN SUBSECTION (1), ITS GOVERNING BODY 10 MAY SUBSEQUENTLY ADOPT A RESOLUTION PROVIDING FOR THE ELECTION 11 EVERY 2 YEARS OF DIRECTORS FOR 2-YEAR TERMS. THE RESOLUTION 12 SHALL PROVIDE FOR THE TRANSITION OF THE ELECTIVE TERMS FROM 3 TO 13 2 YEARS AS FOLLOWS: 14 (A) THE OFFICES OF THE 2 DIRECTORS WHOSE TERMS FIRST EXPIRE 15 AFTER THE ADOPTION OF THE RESOLUTION SHALL BE FILLED AT THE NEXT 16 SCHEDULED LOCAL, STATE, OR FEDERAL ELECTION BY THE ELECTION OF 2 17 DIRECTORS WHO SHALL HOLD OFFICE FOR 2 YEARS, AND THEN EVERY 2 18 YEARS FOR 2 YEARS OR UNTIL THEIR SUCCESSORS ARE ELECTED AND 19 QUALIFIED. 20 (B) THE OFFICES OF THE 2 DIRECTORS WHOSE TERMS NEXT EXPIRE 21 AFTER THE ADOPTION OF THE RESOLUTION SHALL BE FILLED IN THE YEAR 22 FOLLOWING THE ELECTION IN SUBDIVISION (A) BY THE ELECTION OF 2 23 DIRECTORS WHO SHALL HOLD OFFICE FOR 1 YEAR, AND THEN EVERY 2 24 YEARS FOR 2 YEARS OR UNTIL THEIR SUCCESSORS ARE ELECTED AND 25 QUALIFIED. 06337'00 3 1 (C) THE OFFICES OF THE 2 DIRECTORS WHOSE TERMS LAST EXPIRE 2 AFTER THE ADOPTION OF THE RESOLUTION SHALL BE FILLED AS DESCRIBED 3 IN SUBDIVISION (A). 4 (3) Thesaiddirectors shallreceive noSERVE WITHOUT 5 compensation.as such. VacanciesA VACANCY in the board of 6 directors occasioned byremovalsA REMOVAL,resignationsA 7 RESIGNATION, or otherwise,shall be reported to the governing 8 body of the village or township,whoWHICH shall proceed to 9 appoint a director to fillsaidTHE vacancy. 10 Sec. 5. Every community center established under this act 11 shall befree to the use of the inhabitants where located,12alwayssubject to such reasonable rules and regulations as the 13 community board may adopt.; and saidTHE board may exclude 14 from the use ofsaidTHE community building and grounds any 15and all persons who shall wilfullyINDIVIDUALS WHO WILLFULLY 16 violatesuchTHESE rules. 06337'00 Final page.
