A bill to amend 1990 PA 271, entitled "Limousine transportation act," by amending sections 7 and 33 (MCL 257.1907 and 257.1933). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 7. (1) A limo carrier of passengers shall not operate 2 a limousine for the transportation of persons for hire on a 3 public highway in this state except in accordance with this act. 4 A LIMO CARRIER OF PASSENGERS THAT OPERATES CLASS A LIMOUSINES OR 5 CLASS B LIMOUSINES WITHIN A CITY WITH A POPULATION OF 750,000 OR 6 MORE SHALL ALSO COMPLY WITH THE VEHICLE FOR HIRE ORDINANCE OF 7 THAT CITY WITH RESPECT TO THOSE LIMOUSINES. A limo carrier of 8 passengers shall not operate upon a public highway without first 9 having obtained from the department a certificate of authority. 10 A CERTIFICATE OF AUTHORITY MAY BE OBTAINED FOR OPERATION OF 11 EITHER CLASS A LIMOUSINES OR CLASS B LIMOUSINES OR BOTH. 04144'99 ** TJS 2 1 (2) AS USED IN THIS SECTION: 2 (A) "CLASS A LIMOUSINE" MEANS A LIMOUSINE WITH A SEATING 3 CAPACITY OF NOT LESS THAN 7 PASSENGERS BUT NOT MORE THAN 15 PAS- 4 SENGERS INCLUDING THE DRIVER. 5 (B) "CLASS B LIMOUSINE" MEANS A LIMOUSINE WITH A SEATING 6 CAPACITY OF LESS THAN 7 PASSENGERS INCLUDING THE DRIVER. 7 Sec. 33. The department may alter, suspend, or revoke a 8 certificate of authority issued under this act if the department 9 determines in a contested case hearing held pursuant to chapter 4 10 of the administrative procedures act of 1969, Act No. 306 of the 11 Public Acts of 1969, being sections 24.271 to 24.287 of the 12 Michigan Compiled Laws 1969 PA 306, MCL 24.271 TO 24.287, that a 13 person to whom a certificate of authority has been issued has 14 willfully violated or refused to comply with this act OR A LOCAL 15 ORDINANCE OF A UNIT OF GOVERNMENT THAT REGULATES LIMOUSINES. 04144'99 ** Final page.
