A bill to amend 1965 PA 261, entitled "An act to authorize the creation and to prescribe the powers and duties of county and regional parks and recreation commissions; and to prescribe the powers and duties of county boards of super- visors with respect thereto," by amending the title and section 1 (MCL 46.351), section 1 as amended by 1990 PA 84. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 TITLE 2 An act to authorize the creation and to prescribe the powers 3 and duties of county and regional parks and recreation commis- 4 sions; and to prescribe the powers and duties of county boards of 5 supervisors with respect thereto COMMISSIONERS WITH RESPECT TO 6 COUNTY AND REGIONAL PARKS AND RECREATION COMMISSIONS. 7 Sec. 1. (1) The county board of commissioners of a county, 8 by resolution adopted by a 2/3 vote of all its members, may 06168'00 KDD 2 1 create a county parks and recreation commission, which shall be 2 under the general control of the board of commissioners. 3 (2) The county parks and recreation commission shall consist 4 of THE FOLLOWING 10 members: , including the 5 (A) THE chairperson of the county road commission or another 6 road commissioner designated by the board of county road 7 commissioners. , the 8 (B) THE county drain commissioner. , 9 (C) ONE OF THE FOLLOWING: 10 (i) IN A COUNTY THAT HAS A POPULATION OF MORE THAN 1,000,000 11 AND ELECTS A COUNTY EXECUTIVE UNDER SECTION 9 OF 1973 PA 139, MCL 12 45.559, THE COUNTY EXECUTIVE OR A DESIGNEE OF THE COUNTY 13 EXECUTIVE. 14 (ii) IN A COUNTY WITH A POPULATION OF 1,000,000 OR LESS, the 15 chairperson of the county planning commission or another member 16 of the county planning commission designated by the county plan- 17 ning commission. , and 7 members appointed by the county board 18 of commissioners, not less than 1 and not more than 3 of whom 19 shall be members of the board of commissioners. In a county that 20 does not have a county planning commission, the chairperson of 21 the regional planning commission shall serve on the county parks 22 and recreation commission if that person is a resident of that 23 county. If the chairperson of the regional planning commission 24 is not a resident of that county, then the board shall, by a 2/3 25 vote, appoint a member of the regional planning commission who is 26 a resident of that county to serve on the county parks and 27 recreation commission. 06168'00 3 1 (D) SEVEN MEMBERS APPOINTED BY THE COUNTY BOARD OF 2 COMMISSIONERS, NOT LESS THAN 1 AND NOT MORE THAN 3 OF WHOM SHALL 3 BE MEMBERS OF THE BOARD OF COMMISSIONERS. 4 (3) Of the members first appointed by the county board of 5 commissioners, 2 shall be appointed for a term ending 1 year from 6 the following January 1, 2 for a term ending 2 years from the 7 following January 1, and 3 for a term ending 3 years from the 8 following January 1. Thereafter FROM THEN ON, each appointed 9 member shall be appointed for a term of 3 years and until his or 10 her successor is appointed and qualified. Each term shall expire 11 at noon on January 1. A vacancy shall be filled by the county 12 board of commissioners for the unexpired term. 13 (4) (3) The county parks and recreation commission is an 14 agency of the county. The county board of commissioners may make 15 rules and regulations with respect to the county parks and recre- 16 ation commission as the board of commissioners considers 17 advisable. The members of the county parks and recreation com- 18 mission shall not be ARE NOT full-time officers, and the board 19 of commissioners shall fix the compensation of the members. 06168'00 Final page.
