HOUSE BILL No. 5852 May 30, 2000, Introduced by Reps. DeHart, Schermesser, Bovin and Jamnick and referred to the Committee on Appropriations. A bill to amend the Initiated Law of 1976, entitled "A petition to initiate legislation to provide for the use of returnable containers for soft drinks, soda water, carbonated natural or mineral water, other nonalcoholic carbonated drink, and for beer, ale, or other malt drink of whatever alcoholic con- tent, and for certain other beverage containers; to provide for the use of unredeemed bottle deposits; to prescribe the powers and duties of certain state agencies and officials; and to pre- scribe penalties and provide remedies," by amending section 3c (MCL 445.573c), as amended by 1996 PA 384. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 3c. (1) There is created in the department of treasury 2 a bottle deposit fund which is a revolving fund administered by 3 the department of treasury. The money in the bottle deposit fund 4 shall not revert to the general fund. 5 (2) The amount paid to the department of treasury by 6 underredeemers shall be deposited by the department of treasury 03608'99 TMV 2 1 in the bottle deposit fund created in subsection (1) for annual 2 disbursement by the department of treasury in the following 3 manner: 4 (a)Seventy-fiveFIFTY percent to the cleanup and redevel- 5 opment trust fund created in section 3e. 6 (B) TWENTY-FIVE PERCENT TO THE OLDER MICHIGANIANS PHARMACEU- 7 TICAL ASSISTANCE FUND. 8 (C)(b)Twenty-five percent to dealers to be apportioned 9 to each dealer on the basis of the number of empty returnable 10 containers handled by a dealer as determined by the department of 11 treasury. 12 (3) Not later than June 1 of each year, the department of 13 treasury shall publish and make available to the public informa- 14 tion related to section 3b(1) and send a report of that informa- 15 tion to the legislature. 16 (4) The department of treasury may promulgate rules to 17 implement sections 3a to 3d pursuant to the administrative proce- 18 dures act of 1969,Act No. 306 of the Public Acts of 1969, being19sections 24.201 to 24.328 of the Michigan Compiled Laws1969 PA 20 306, MCL 24.201 TO 24.328, if the department of treasury deter- 21 mines that rules are needed to properly implement and administer 22 sections 3a to 3d. 03608'99 Final page.
