A bill to amend 1982 PA 294, entitled "Friend of the court act," by amending section 9 (MCL 552.509), as amended by 1998 PA 63. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 9. (1) Except as otherwise provided in the order or 2 judgment, after a support order is entered in a domestic rela- 3 tions matter, the office shall receive all payments of support 4 orders and service fees; shall, not less than once each month, 5 record the support payments due, paid, and past due; and shall 6 disburse all support payments to the recipient of support within 7145 days after the office receives each payment. IF THE 8 OFFICE FAILS TO DISTRIBUTE A SUPPORT PAYMENT WITHIN THE TIME 9 REQUIRED BY THIS SUBSECTION, THE OFFICE SHALL INCLUDE INTEREST ON 10 THAT PAYMENT FOR EACH DAY THE MONEY IS DISTRIBUTED LATE. THE 11 OFFICE SHALL CALCULATE THE INTEREST REQUIRED BY THIS SUBSECTION 04393'99 GWH 2 1 AT THE RATE CERTIFIED BY THE STATE TREASURER, WHICH RATE SHALL BE 2 EQUAL TO THE AVERAGE INTEREST RATE FOR FINANCIAL INSTITUTIONS OR 3 SELECTED FINANCIAL INSTITUTIONS EITHER STATEWIDE, IN THE METRO 4 DETROIT AREA, OR IN DETROIT, AS PUBLISHED IN A NEWSPAPER WITH A 5 STATEWIDE CIRCULATION. 6 (2) The office shall provide annually to each party, without 7 charge, 1 statement of account upon request. Additional state- 8 ments of account shall be provided at a reasonable fee sufficient 9 to pay for the cost of reproduction. Statements provided under 10 this subsection are in addition to statements provided for admin- 11 istrative and judicial hearings. 12 (3) The office shall initiate and carry out proceedings to 13 enforce an order entered in a domestic relations matter regarding 14 custody, parenting time, health care coverage, or support in 15 accordance with this act, the support and parenting time enforce- 16 ment act, and supreme court rules. 17 (4) Upon request of a child support agency of another state, 18 the office shall initiate and carry out certain proceedings to 19 enforce support orders entered in the other state without the 20 need to register the order as a domestic relations matter in this 21 state.
