THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 53. To obtain the printing of IN ORDER FOR the name 2 of a person as a candidate for nomination by a political party 3 for the office of governor TO APPEAR under a particular party 4 heading upon ON the official primary ballots, there shall be 5 filed with the secretary of state nominating petitions BALLOT, A 06852'00 CAS 2 1 NOMINATING PETITION SHALL BE signed by a number of qualified and 2 registered electors residing in this state as determined under 3 section 544f. Nominating petitions THE NOMINATING PETITION 4 shall be signed by at least 100 registered resident electors in 5 each of at least 1/2 of the congressional districts of the 6 state. Nominating petitions A NOMINATING PETITION shall be in 7 the form as prescribed in section 544c . (1) To obtain the printing of EXCEPT AS PRO- 4 VIDED IN SUBSECTION (2), IN ORDER FOR the name of a person as a 5 candidate for nomination by a political party for the office of 6 state senator or STATE representative TO APPEAR under a particu- 7 lar party heading upon ON the official primary ballots in the 8 various election precincts of a district, there shall be filed 9 nominating petitions BALLOT, A NOMINATING PETITION SHALL BE 10 signed by a number of qualified and registered electors residing 11 in the district as determined under section 544f. If the dis- 12 trict comprises more than 1 county, the nominating petitions 13 PETITION shall be filed with the secretary of state. If the dis- 14 trict comprises IS WITHIN 1 county, or less, the nominating 15 petitions PETITION shall be filed with the county clerk of that 16 county. Nominating petitions shall be in the form prescribed in 17 section 544c. The NOMINATING PETITION SHALL BE FILED WITH THE 18 secretary of state and the various county clerks shall receive 19 nominating petitions for filing in accordance with this act up 20 to OR COUNTY CLERK NO LATER THAN 4 p.m. of the twelfth 21 SIXTEENTH Tuesday preceding BEFORE the August primary IF A CAN- 22 DIDATE IS THE INCUMBENT, AND NO LATER THAN 4 P.M. OF THE TWELFTH 23 TUESDAY BEFORE THE AUGUST PRIMARY IF A CANDIDATE IS NOT THE 24 INCUMBENT. 25 (2) In lieu INSTEAD of filing a nominating petition, THE 26 CANDIDATE MAY PAY a filing fee of $100.00 may be paid to the 27 county clerk or, for a candidate in a district comprising more 06852'00 6 1 than 1 county, to the secretary of state. Payment of the fee and 2 certification of the name of the candidate paying the fee shall 3 be ARE governed by the same provisions as in the case of FOR A 4 nominating petitions PETITION. The fee shall be deposited in 5 the general fund of the county OR STATE and shall be refunded to 6 candidates who are nominated and to an equal number of candidates 7 who receive the next highest number of votes in the primary 8 election. If 2 or more candidates tie in having the lowest 9 number of votes allowing a refund, the sum of $100.00 shall be 10 divided among them. A refund of a deposit shall not be made to a 11 candidate who withdraws as a candidate. 12 Sec. 164. THE nominating petitions 2 PETITION SHALL BE signed by a number of qualified and registered 3 electors residing within the county as determined under 4 section 544f. Payment of the fee and certification of the candidate's 18 name paying the fee shall be ARE governed by the same provi- 19 sions as in the case of FOR A nominating petitions PETITION. 20 The fee shall be deposited in the general fund of the county and 21 shall be refunded to candidates who are nominated and to an equal 22 number of candidates who receive the next highest number of votes 23 in the primary election. (1) To obtain the printing of EXCEPT AS PRO- 18 VIDED IN SUBSECTION (2), IN ORDER FOR the name of a person as 19 candidate for nomination by a political party for the office of 20 county auditor TO APPEAR under a particular party heading upon 21 ON the official primary ballots, there shall be filed with the 22 county clerk nominating petitions BALLOT, A NOMINATING PETITION 23 SHALL BE signed by a number of qualified and registered electors 24 residing within the county as determined under section 544f. 25 Nominating petitions shall be in the form prescribed in section 26 544c.
